Author Topic: Please advise, my CIL got her permit taken away!  (Read 360 times)

Hi! I have a somewhat big problem with immigration and I would like some advice.

I'm a skilled worker, I'm not Canadian but I've been herefor three years.

My common-in-law is Chinese and she is here on a study permit, but she didn't take courses the last two semesters and we were going to ask for an open work permit, sponsored by me.

We also applied for PR.

A week ago she was going to NY to visit and to go to the consulate to get the permit but we didn'tnotice that the passport was 6 months from expiring so the didn't let her in US (a matter of a few days)

On her way back at the Canadian border, they found that she was not going school so the took away the stud permit and even if she still has her tempprary visa, they told her to go bac to China in two weeks and re-apply there.

What should we do? Would it be safeto go back China and ask for the work permit (or another study one) there? Or there is the concrete risk of being refused?

Should we get a lawyer? Anyone can suggest a good one? We don't havemuch time to decide!

Thanks, I just mailed them. Btw in the experience of the forum, would it be hard to get an open work permit in China?

How did Canada find out that she was not studying?  There have been many posts wondering how muich a brder guard knows from his computer terminal about you as you cross into Canada. Did the border guard know she wasn't studying any more?

Nov 09 Approved; sent to Hong Kong.
Interview April 4, 2011 (so slow!!). Passed.
15 April 2011 New medical done.
7 July 2011  COPR received.
15 July 2011 landed in Vancouver. At last.
