HI to all experts. i m in very confusing stage.  right now m in brampton canada on study visa ,, i came here 3 rd jan 2011. and did only one smester in study . and since MAY  i m not doing any study.  due to some personal problems.  i m thinking to stay here till AUGUST 2012 without study and then go back,, and after that i wil apply for PR  from india , not for study visa .. so will my current status effect on my IMMIGRATION PROCESS?? my backround in india was nursing ...

Hi,
If your profession is listed in cic list of FSW, you score 67 points and if CAP not reached, you can apply
It will not affect anything on Immigration process, but you have to write the detail of stay in Canada and need PCC.

HI thanks for reply but .. just confused.. i m here on student visa , means my aim is study .. but i m not doing study..so immigration will officer ask me tht wht u did in canada whn u was there on study visa. so wht would be the reason i can give that why i didnt do study whn i was in  canada?  please guide me please.

Y U WANT TO WAIT TILL AUG 2012.....U CAN APPLY RIGHT NOW..PROVIDED U SCORE 67 POINTS....N U CAN SHOW THAT U R ON STUDENT VISA.

Hi Gavi,

Irrespective of where you reside when you apply for PR, you will have to mention what you were doing and where you resided. So, if you are thinking that you can avoid that by applying from India, then that's not possible.

1. As already been suggested by Canadestin and hmisabpk, you could apply for PR if you have experience in the current NOC for 1 continuous year acquired in the last 10 yrs. Also you will have to have IELTS.

2. If your concern is that, even though you were on study permit you did not honour that condition (To continue studying) then CIC does not care about it although not a very good attitude and should be avoided; this can cause problems in future requests for Study or other permits. But you will have to clearly mention that you studied until May 2011 and have not been studying since then when you fill up the forms. Also add a cover note to explain why you could not continue further.

3. For you to be eligible to apply with Buffalo as VO is your admissibility in Canada for atleast 1 year...which you possess.

4. Since you will return to your home country after applying (if you apply now) , then it is advisable to have your home country as your VISA OFFICE.

Dont hide anything from VO. Ask for suggestions here on the forum and somebody will help you.

TWAKAL>> right now i dont have  complete 67 points.  but in sep 2012 i will get married .my wife qualification is diploma in nursing (3 and half year) and also hav 1 year hospital experiance . right now she is doing bsc nursing first year in india., i think may b i will apply immigration through her and apply myself as a spouse..couze in my case i have some negative points like( drop in study in canada while on a study visa), whts your opinion .

and one more question is that 55 points needed for ALBERTA IMMIGRATION  or that is same 67 like ONTARIO???
and  which other provinances demand less thn 67 points . please reply sir.

and i cannot apply from here because my points are not sufficent right now . it will complete when i get marry in sep 2012.
and wht i can write the reasan about my study drop. right now m working on cash and will do till august 2012. 
so wht shuld i write reason about study when i apply for IMMIGRATION.

SO what shuld i do right now? according to my situtaion. thanksYou dont qualify now, and it is not guaranteed that the NOC you/would be spouse have will be included in 2012 NOC list. It could also be possible that FSW Immigration might be put on hold to clear backlogs.

PLEASE  please familialise yourself with the rules and regulations of the Country you live in ......there is no excuse for being ignorant......this is for your own good. and will do till august 2012.

You may not be asked this question by CIC for your PR application but you will have to mention in the forms the time period of your actual study and the time period you were not studying

You may not be asked the above questions by CIC when you apply for PR, because they are interested only if you qualify in the legal manner. What you did and how you managed to live in Canada is not their concern at least for your PR application. But what you are doing now is illegal (working without a proper WP) and you could be banned from applying for PR for a specified time if you are caught. Please try to legalise your stay in Canada, please.

First its Ms Mitali...

In Australia if you do not comply with student visa conditions i.e studying full time then you visa gets  cancelled and 30 days to leave Australia, unless you are from visa free Countries...dont let this effect your future prospects...

SORRY  sir , could you please tel me the meaning of Buffalo and VO here..

 and wht shuld i do now..... shuld continue with study  (with the 8 month study gap) in jan with progmm which is not related with my field cause i culdnt get admission in health related programm .? i m realy confused . is that not a wastage of money according to my current conditions?

All applicants have to choose their Visa office (VO). If they live in their homecountry then they choose their homecountry as the VO. Suppose you live in India then NEW DELHI will be your VO.

Suppose now you are living in Canada, then you have the 2 choices : One would be your Homecuntry VO ie , New Delhi and the other would be Buffalo (in Usa) which caters for applicants from Canada.

What would you do?....is totally your decision.....

This is what I felt after reading your post:

1. You dont qualify for PR now.....so cannot apply.

2. Can apply only after Sept 2012.....but there is no guarantee that your NOC would be in the list.

3. You are not having proper paper work to work legally now....and it seems to me ( I may be wrong) there are no chances to make it legal.

4. Even if you went back to studying from Jan 2012, it will not help your PR application. But it will help you earn some Canadian Experience which is of Utmost importance and also induce some positivity - that after initial failure you jumped back to honour your Student visa. Also remember that future applications for Student visa might be dependent on the fact that you had respected the earlier one. Dont let the past mistakes come and bite you later. Huh

IMO, it will be in your interest if you could continue with the course from January 2012. Explore the possibility to work with your Student visa.

When it will be time to apply for an extension for your student visa, dont miss the deadline and you will be on Implied status till the application is processed and will still be able to live in Canada legally.

OR, you can return to your homecountry and avoid all the hassle and apply for PR from there when you have enough points (hopefully NOC will still be there in list).

DEAR sir .. MR MITALI.  one question ..if i continue my study ,,so what u think ,wil i make a good path to get a PR on the basis of STUDENT VISA not on the
basis of POINT SYSTEM IMMIGRATION?  that m confused ;; means If m not thinking to complete 67 points for immigration ,,thinking according to student visa rules to get PR. so then , now i will face any problm to get PR  as per my continuing situtions .>?? please reply sir,,
