After reading the posts and replies in the topic: http://www.canadavisa.com/canada-immigration-discussion-board/very-troublesome-and-painful-story-t67424.0.html, I wanted to share a real life example of mis-representation that happened to a friend of my friend. Here it is: "Mr XYZ applied for PR when he was single. He got the PR after waiting for more than one year, it was an ordeal. He did his medical and was waiting for his PPR, when his parents started looking for his marriage. He got engaged, when the PPR arrived. He sent his passports and he told his parents to date the marriage after he gets the ppt. He got it in one month. His marriage was in 4 weeks. He prepared for it, and asked many people about his situation...he got his COPR and visa. My friend advised him to land first before getting married. He was budgeting and said could not spend 1 lakh with the marriage around the corner. He went ahead with the marriage and then he landed within a week. His landing was a breeze. He saw a house, got a job in 2 weeks. He started processing for his new wife. Sent the application...... Application REJECTED. The reason that they gave is, mis-representation. The date on the marriage certificate is before the date he landed (just 3 days actually). He appealed the decision, went to the court, wrote to the immigration minister. No use, they clearly said, when you signed the documents in the port of entry, it said you are single and you acknowledged it, but in reality you were married, so that is mis-representation. They said, due to the mis-representation you are flagged in our system, and since you became a PR with mis-representation we have to revoke it. He was devastated. Lost his savings, lost his job, lost his PR, went back home." Request: Please do not think that you are smart and you can easily lie and no one would find out. simple fact - DO NOT LIE. My friend told me this when he was advising me on the PR application. All they need is one figment of information, they have teams of experts, they will clearly find out the truth.

I am feeling extremely sad about Mr. XYS's situation, but its a lesson for everyone in the process of PR.

May be he was not willing to reveal that he was married, unwillingness to reveal something cannot be termed as Lie in all conditions. This story is like a Devil's tale.

You are confusing Truth and integrity. They are friends complimenting each other not the other way. Unwilllingness to reveal something is a Lie, when it harms others! Here it harms the immigration process. It is like copying in an exam or sheltering a killer. You become an accomplice not a hero. Gandhi was an outlaw, his unwillingness to reveal his plans and steps are famous, but he was also the recent example for truth. May be he was not willing to reveal that he was married, unwillingness to reveal something cannot be termed as Lie in all conditions. This story is like a Devil's tale.

I think he did not understand the facts clearly and wasn't aware of the procedure otherwise he would have shown marriage date after he landed in Canada. Bad luck...........

Far from it, the rules are quite clear. If anyone want to immigrate to Canada they have to abide by the rules. It is the applicants responsibility to ensure everything is correct. Applicants have to inform CIC of material facts that impact their application. Intentional lie or not, he signed a document that stated he was not married, that was a false statement = misrepresentation = removal of PR. It seems like the right outcome (based on the facts detailed here). Why should this person be allowed to ignore/flaunt the rules, when so many others try their beset to follow them?

Very tragic real life story.... Feel really sorry for him.... One of most happy and important event in his life jeopardized for the other!!! Having full faith on the IMM rules and system and agreeing on many of what commented (He should have followed accordingly)... It is rather reasonable to expect at least a lifeline or opportunity to self defense...(Even in a murder case it prevails!!)... Intentional Ignoring might be a crime but how could it best be judged!!! The official system could revise to opt for giving a chance... the applicant of such case (Misinterpretation!!) could be refused at POE and then can at least have a chance to follow/rectify procedure to include spouse in due ways.... pay the fees, update IMM form (personal info)... they could be delayed or be let in long ques.... to just remind others to follow it strictly.... but straightway rejection at this stage is really very harsh and for the reason stated could have been a bit modified....Pl don't get me wrong I am fully supportive to follow the set rules of IMM but the execution could have few/limited options/clauses if possible

I understand what you say, we all have valid opinions.
I think the point that I see it from is he did have a chance, two actually.
1) He should have notified CIC as soon as he married (I would have contacted them to let them know it was going to happen). The PR would have been delayed.
2) When he landed he would have confirmed his single status, he should have told the truth.

It's not India or Bangladesh where some one would ask you like that " "Listen Mr....., we know that you are married, tell us the truth why youre hiding this from us, if your reply is satisfactory then its good, else your PR would be revoked" Its Canada where they follow the set rules at any cost. Same goes to Europe where law and justice is above everything. Thats the reason why these countries have progressed and are developed countries. The person made the mistake in not declaring his marriage earlier and then again he did the blunder that he signed at POE that he is single and later he claimed the marriage before his date of landing.........
