Paystubs for AINP Canada

Hi,
I m under h1b visa in US right now and willing to file for AINP (Alberta Immigration Nomineed Programme) in canada. After i file, i want to go back to my home country cause i have been working in the US for some time now. the problem is my current employer is not giving me paystubs and AINP requires it. Because of recession also, i have not been able to find any work.

The AINP programme requires paystubs and i do not have it. My questions are :

1. how many paystubs are required for AINP ?
2 am i illegal or out of status in US ?
3 how can i get my paystubs from my current employer ?
4 My employer has not paid me in 6 months can i claim paystubs ?

Hi JOSHI,

For your kind information now AINP processing times changed 5 months to 8 months or may go year also.
Any how most of the guys they will not be in H1B status, this is the way alberta AINP restrict the AINP Nominies.

Think practically while taking any decision .....................

1. Most recent. They will request for one when they make the final decision (Nomination stage and not CIC process) on your application.

2. If your status is H1B and no paystubs, then yes you are out of status in US. But you are safe if your employer is still running your payroll and not just sending the checks to you.

Once u report to department of labour about your employer you will get ur paystubs and money for those 6 months but also ask attorney before complaning to DOL... But rather than complaining try asking him politely that u have some financial problems
