Dear All Seniors, My Brother is Maj. in Pak Army and his spouse is Doctor and she wana apply for immigration following are some informations regarding her case. Years of Qualification 20years completed and currently in 21st year Phd. student. IELTS Acadamic 7.5, 7.5, 7.5, 7.5 Work Experience 2.5 years as Medical Officer 2 years as medical professor 1 year as pathologist. all other factors of evaluations are also excellent. as per Army policy my brother can not apply as main applicant or co-applicant during his service in army so he can not provide details of background declaration form during his service e.g. names of his commanding officers during his service etc. his retirement is due in 2013. if his spouse apply and only add children in application as dependents accompanying with her to canada but not her husband. can he join his family after his retirement ? please suggest what to do and how to solve this legal problem in immigration case. cheeta

Dear All Seniors, My Brother is Maj. in Pak Army and his spouse is Doctor and she wana apply for immigration following are some informations regarding her case. Years of Qualification 20years completed and currently in 21st year Phd. student. IELTS Acadamic 7.5, 7.5, 7.5, 7.5 Work Experience 2.5 years as Medical Officer 2 years as medical professor 1 year as pathologist. all other factors of evaluations are also excellent. as per Army policy my brother can not apply as main applicant or co-applicant during his service in army so he can not provide details of background declaration form during his service e.g. names of his commanding officers during his service etc. his retirement is due in 2013. if his spouse apply and only add children in application as dependents accompanying with her to canada but not her husband. can he join his family after his retirement ? please suggest what to do and how to solve this legal problem in immigration case. cheeta

Hello  Ok to answer your questions.. 1) Birth certificates - as I understand it, some India and Pakistani applicants did not have birth certificates issued until after a certain date. Therefore it was impossible for some applicants to have a birth certificate issued "soon after their birth". Recently CIO have been accepting 10th grade certificates in place of birth certificate. But if you have a genuine birth certificate even if this was issued many years after your birth, it is still a valid proof of your birth. So IMO you will be fine, although if you can also provide your 10th grade certificate as additional proof of birth then it might be a good idea to also include this. 2) Work references - please check your visa-office specific checklist (assuming for Pakistan this will be CHC London?) regarding exactly what is required, since it varies slightly from visa office to visa office. However, generally you will need work reference letters detailing salary, start date, end date, hours worked and the duties your performed. You will also need notarized copies of the employment contracts, including notarized translations in English or French if the original contracts are not in English or French. 3) Degree results - hmm, try to speak with others from your country on what they did here. I know in the UK that Universities will send degree transcripts in sealed envelopes direct to us. In fact owing to the Data Protection Act it's illegal for them NOT to do this. But this probably varies from country to country. I think it's quite important to try to get them yourself since it is not easy for CIO to match up documents sent to them with applications. Most likely whoever does your completeness check will simply fail the application as incomplete if the transcripts are not there. Best of luck with your application, Wayne.

7 years back I lived in Japan for two years for my studies, and now getting a police certificate from Japan would take 2-3 months (told by Japanese embassy people in my country) What should I do to seek more time from VO. Should I reply this mail requesting for more time after explaining the situation etc. Similarly why they are asking again for POF? Isn't a bank statement enough or they just need a fresh copy? Please share your views and insights Thanks

There is nothing in the Canadian Law that prevents Army officers or their spouses from applying but Army officers as principle applicants have to give their details of military service and their involvement in active combat operations. If your brother is applying as a spouse of the principle applicant then there is no need to provide reference letters OR names of the commanding officers. Army laws may prevent your brother for being the principle applicant but should not prevent his spouse to be a principle applicant. I don't know the law but your brother have 2 options. 1- Ask the commanding officer about the law, apply get processed as a co-applicant and return back just after finishing the landing procedure. Go back after the retirement. 2- Let his wife apply and go to Canada and apply in the family sponsorship after the retirement. (But that will take about 13-14 months after the application. IELTS Academic is not acceptable for CHC. They only accept General option and I think for someone with such a score in Academic, General option shouldn't be a problem. Dont write the e mail it will be lost in the storm. Write a letter starting with Date ----- SUBJECT : -------------------- Dear Visa Officer -----------------
and send the hard copy with the remaining documents which you are able to gather. You have to provide an explanation to the visa officer against any missing document and it is better that you provide a proof that you are trying to get their required doc. For example when you will apply for Japanese PCC they will give you some receipt. You can send a copy of that receipt with a letter that you have already applied but it is not possible to get it within 45 days time period which they have given. Every applicant aged 18 and above need to fill out Schedule 1 Form which include Military Services details. So even if the Major is applying as a spouse, he still needs to give all the information about his military service to CIC.
Army Laws don,t prevent any person to become principal applicant rather they want the soldier to obey the agreement, a soldier signs while joining in Service.
In option No. 1 Army will not let him go during his service.
In Option No. 2 If the wife includes her husband in the application, then the husband still needs to give ALL military information but he will be included in the application as non-accompanying so will not go to Canada. In this case the situation remains the same, he need to provide everything C.O name each and every combat etc. And if the wife entirely don,t show the husband in the application, then they will be devastated and she will NEVER be able to sponsor her husband in family class in future after reaching Canada.
