I received some personal messages and was requested to send my refusal review request letter. So, here it is. I am sure it will be very helpful especially for those whose applications are being refused due to miscalculation of points by the visa officer.

Sir/ Madam,

Reference to the above referred application, it is stated that I have received Refusal Letter dated: 10th January 2012 (Copy Enclosed), intimating therein that the Principal Applicant have not meet the minimum qualifying criteria, i.e. 67 Points out of 100 Points. Therefore, the Visa Officer is not satisfied that the Principal Applicant will be able to become economically established in Canada and hence refused the above referred Application.

I believe that there is an error of judgement, while awarding points for Adaptability factor (Spouse Education). The Visa Officer has mistakenly awarded 03 Points instead of 04 Points for Adaptability (Spouse Education), which is not in accordance with the criteria formulated by the Canadian Immigration Department. In the Adaptability Criteria given in the Guidance Notes for Federal Skilled Workers Category published in the month of November 2008, as well as in the latest Instruction Guide given at your official web-site www.cic.gc.ca, it is very clearly mentioned that in case the Applicant's Spouse has “.........University degree of two years or more and at least 14 years of full-time of full-time equivalent studies, the applicant deserves 04 points. As a proof of the same, I am enclosing herewith photocopy of Page No. 16 of the afore-mentioned Guidance Notes and the relevant portion of the same has been highlighted for your perusal.

In these circumstances, it is , therefore, requested to kindly look into the matter carefully, thereby overturning the decision because it is very clearly mentioned in the Guidance Notes for Federal Skilled Workers Category published in the month of November, 2008, as well as in the latest instructions Guidance given at the official web-site www.cic.gc.ca that in case the applicant's spouse has “............ university degree of two years or more and at least 14 years of full-time or full –time equivalent studies, the applicant deserves 04 points

Thanks for advice, did u get medicals ? Did u send the required docs already ?

After re-opening of my case, I was told to send RPRF fee, updated forms, police clearance certificates and updated pictures of both children. Interestingly, When my case was re-opened/approved they informed me by e-mail that medical forms alongwith additional documents is being sent in next few day. 10 days later, I got a call from TCS and it included all my original documents, degrees and other required documents list but there was no medical. I discussed this matter with some experts and was told that as physical appearance of kids changes a lot during early years, that why they held MR request and asked me send latest pictures. I believe that after receiving that, they will fix new pictures of the kids on MR forms and will send that to me soon.

I have also applied in July 2009, and on 22 march got letter by tcs with all originals, asking RPRF + PCC + new forms + photos.
I will send all this in couple of days now, let us see when we get medicals

Dear Folks specially those are pre june and sent their updated forms, please tell me about the form IMM5406E(04-2008), is it the same form we sent in 2009 when we completed the application or there are any updated/new form available...?, I have downloaded the new forms from uk VO site but it is the same form and in my demand list of forms they have asked for new IMM5406 form, where can I find the new form please help.....

Yes, I have send all the required documents within 1 week and now hoping to get medical papers soon.
By the way, our timelines (July-sept 2009) are exactly the same.

(2)  MBA 2 years Regular ( 2010)

medical done on 27th feb 2012 , still waiting for the update no responce from any one please suggest what to do, i already send e-mail to ldn immigeration office my current online status is

We transferred your application to the London England office on June 9, 2009. The London England office may contact you.

Your application was reviewed and we started processing on October 18, 2010. (  Al most 1 1/2 sall say process kar rahay hay aisa kia process ho raha hay bhai Jo agay he nahi ja raha hay )

I sent one email to CIC for adding my new born baby in application, they send me two different emails with different dates, they sent on march 7th and another one march 27th. i m confuse which email should i follow, anyone guide me please.

on 7th march email

In order to add the child to an application for permanent residence at this office, we require the following documents:
•   processing fee for your child (if accompanying you to Canada)
•   your child's birth certificate
•   copy of your child's valid passport
•   4 recent photographs of your child
•   updated IMM0008 Generic for yourself and updated IMM5406 “Additional Family Information” form for yourself and your spouse.



on 27th march email

So that we may add your baby to your application, please submit the following documents within the next 60 days. You should wait until you have received the medical form for your baby, and then complete your medical examinations together as a family.
 
 Updated forms which are available on our website:
•   New Schedule A/Background Declaration form for yourself and each family member over the age of 18
•   New Additional Family Information form IMM5406 for yourself and each family member over the age of 18
Documents for your new baby:
•   Processing fee of $150 - The forms of payment accepted by our office in London are listed on our website.  Unlike the Visa Office in Islamabad, we cannot accept direct deposit payments to the Standard Chartered Bank, Pakistan.
•   2 passport photos
•   Long form birth certificate
•   Copy of passport biopage
