Author Topic: Outland PR : Korean/Canadian 'Current mailing address' question  (Read 124 times)

Hi,

My background:
I am a Canadian citizen.
My common-law partner/fiance (soon to be wife) is a Korean national.
I have lived in Korea for almost 3 years.  (not currently residing in Canada.)
I plan to leave Korea in about 6 weeks.  (or possibly a bit longer pending this situation) 
Me and my fiance are planning to travel together and have thought we should enter Canada using a tourist visa and then apply for PR status for her from Canada.
We have lived together for almost 18 months and have supporting evidence of this. 
I have just realized that the sponsoring of her as a PR seems much better (time wise) doing it OUTLAND through Seoul.   (I know doing OUTLAND that there is the chance of an interview in Korea if we travel to Canada together, but this seems to me a better option if it means shaving off 1.5 years off the process... and of course there is also the risk of my fiance not being admitted on a tourist visa at a Canadian border agent's discretion... but I would hope that if she has a return ticket, sufficient funds, and is open an honest about our OUTLAND PR sponsoring application, that there shouldn't be a problem.)

My question/concern:
(1) Since I am not currently a Canadian resident, but plan return and reside in Canada in the next few months and attend university in September (although I have yet to acquire a letter of acceptance) , can I still apply to MISSISSAUGA to get the initial sponsorship paperwork for my fiance as an OUTLAND case before I move back to Canada?

(2) If yes... and I can apply to MISSISSAUGA and get the initial sponsorship paperwork from outside the country for a PR OUTLAND process, then should I, for honesty sake give my current address in Korea (which will soon change), or give my parents address in Canada as more stable Canadian based address for the whole process... as my CURRENT MAILING ADDRESS.
  .... if I give my parent's address... which is a more 'stable' mailing address for me over the next 6 months... would this not thrown into question the legitimacy of our whole application if we are in effect proving we have lived together for one year over the past year? 

(3) Or should we wait and go to Canada, get married there and apply for an INLAND PR case even though it may take 2+years?

1. Yes.  Be sure to make mention somewhere of your plans to return to Canada shortly thereafter.  That way you won't be asked to provide proof of your intentions to re-settle later on in the process.

2. Use the Canadian address.  The proof of your living together will come from other things (mail, lease, passport entry and exit stamps) etc.

3. Apply Outland.  She is visa-exempt and can visit with you while the application is processing, and if for any reason she needs to return to Korea in the meanwhile, her application processing will not be jeopardised by her need to leave Canada.

Please note, if you are applying as common-law, it is best not to mention your plans to marry later.  Sometimes this can delay the processing, as they might decide you are not certain of your commitment and are applying for PR to continue "trying out" your relationship.  Or, alternately, you can go ahead and get married if you're not planning the whole shebang but going for something simpler.
