Open Visa query... Currently IN Canada

Grateful for some advice...

My family and I have moved to Canada as my husband was offered an employment position. Due to his Visa, I was able to obtain an Open Visa to work as well.

I have secured a job and currently working however it looks as though my husband may lose his job. If this is the case, will I also lose my Open Visa?

What are our options to stay? Could we apply under the Nominee Programme for PR using myself as the Principal applicant?

Are we able to stay as visitors and would we both have to go through the Visa process again to be able to work??

1.   Your OWP will remain valid until it's expiry as long as your spouse is in Canada.  If he leaves, your WP is invalid.
2.   Check the PNP programs to see if you qualify at www.cic.gc.ca
3.   You can apply to extend as a visitor, when your status ends.  Your spouse would have to find an employer who is able to get an LMO after advertising, only then can he apply for a new work permit.

We have submitted an application to extend our current permits (as they were only 1 year in length, valid until December 2011). I doubt we would get any kind of response until October.

I am eligible to apply for the Alberta Nominee programme as my job falls under NOC, but as it was not advertised on the job bank, (and I gained employment while having an OWP), I am not sure if it will be successful.  I submitted a cold call resume to my current employer (in the broadcast industry) and it just happened that they were looking for someone in a particular role. I have been there for 6 months and have recently been promoted.

Would my employer have to go through the LMO process?

1.  Yes the employer would require an LMO.  If your spouse doesn't have a new LMO, then what status is he applying for?  If it is as a visitor, your OWP expires.

We submitted an online application to extend our work permits via CIC website. The online form did not ask for an LMO , but we did submit everything else as requested.
