Sorry I can't paste the actual wording, but check out #34 and #35 on page 12 of the document. QUESTION: CIC policy is that police certificates must have been issued no more than three months before an application is submitted. Does this 3-month policy apply to countries where the applicant is no longer a resident and has not been a resident for some time? ANSWER: Yes, except in those instances where the applicant can provide a genuine police certificate that covers the period of time spent in that country, issued at or about the time they left that country.
And the next ANSWER: This policy is not being re-considered. When an applicant did not obtain a police certificate before leaving that country, the applicant is obliged to try to obtain one within CIC's timeframe. Visa offices may exercise discretion in unusual circumstances.
Except I think you will find, the VO will request a new criminal records check, no matter what the discussion was with the Immigration practitioners. The OP would have to prove to the VO's satisfaction that they had never returned to that country.
