Author Topic: Offer letter but no LMO?  (Read 360 times)

I am currently in Canada on a Work Permit only valid for my current employer.  I mailed a permanent residence application (spousal, I am married to a Canadian) and a request for an open work permit a couple of weeks ago - I am confident it will be approved, included all the requested documentation.  Now I hear that it can be 6-7 months before I will have the open WP.

My current situation is that my employer stopped paying me a salary and now I am earning commission only.  This means I won't be able to support my family / pay rent etc. and thus I need a new (paying) job.  Of course without an open WP I can't get a new job, and this will be causing me serious financial trouble, or worse we could be homeless.

There is a company that wants to hire me, but they say that they won't be able to meet LMO conditions .  However, they are giving me a letter stating they want to bring me on board as soon as possible - once I have an open WP.

My question is, will that letter provide me with any leverage if I were to go to the local CIC office?  Is there anything possible on compassionate grounds?  Should I get legal help?

No leverage at all, you want to change jobs you need an LMO.  I suggest you look at the contract with your employer that they got the LMO with as it probably states a salary as HRSDC will not approve commission only jobs.
