Author Topic: No Birth Certificate...affadavit submited but not accepted (Urgent)  (Read 574 times)

Dear All/Guru's,

Myself and my spouse donot have birth certificate from India. During the initial submission of documents,I have got affadavit from my parents and my inlaws for me and my spouse. Unfortunately, the affadavit was not drafted properly. The affadavit mentions the "birth certificate was incomplete" instead of stating as Birth was not registered or birth certificate is unavailable.

Almost 2 years after, I have been requested for medicals and birth certificate again and stating that affadavit is not acceptable since the affadavit is mentioned as "birth certificate is incomplete".  

Now, I have managed to get "No record found birth certificate" from village/town for myself and my spouse. Also, I have managed to get from Indian Embassy a birth record certificate that they have extracted from my passport. Do i still need to get a new affadavit from my parents stating that the birth is not registered and birth certificate not available. Is it correct to get the new affadavit once again from my parents inspite of submitting a previous affadavit from my parents stating that the "birth certificate is incomplete"

This is my last chance. I already made a mistake by not drafting a correct affadavit and this time , i want to be carefull.

Please help me guru's and what needs to be done. Thanks.

Where is your visa office? How much time did they give you to submit the document?

1st Record not found certificate is fine if it is not in english then better translate that certificate in english.
2nd if u have 10th class date of birth certificate with your application along with ( Record not found date of birth certifcate) that make your case more stronger.
no need to give affidavit from your parents above certificates is enough.

what about school leaving certificate that's also accepted as proof of birth instead of birth certificate.
Try to get burth certificate from indian consulate it's also valid to prove your birth date validation.
incomplete birth certification is not valid documents from india or not valid to submit for immigration purposes.
incomplete record or missing record you must have to clear before apply any immigration this will create lots of confussion and problem during immigration case is in process for any country.
try to get birth certificate from indian embassy and submit that as well as school leaving certificate in english (if you have).
I submitted dual langaug gujarati + english school leaving certificate only to prove my birth record (accepted).

Visa office is Buffalo,NY. They have provided 3months and it is almost 2 months completion now.

That's good enough.

1. is not required but you know better your application process, explain in written seperate covering letter.

CIC does not recognize Passport and Birth record certificate from Embassy as "Proof of Birth" document....their justification lies in the fact that these documents can be doctored.......as it is easy to acquire/procure these docs through wrongful means.

Your "10th grade certificate" and "No found certificate" will work. But no harm in submitting all of them.

10 th pass certificate having date of birth is acceptable as birth proof .There are many peoples in this forum who submitted this certificate alone and are through the process.
so 10th pass cert. would suffice

Rajspeeder,
you can very well use your 10th pass certificate instead of birth certificate.
If you can get a " No record found" about registartion of your birth from your local Panchayat/Village office in English, you can use it as a supporting document.

10th certificate is acceptable as proof of civil status / age / birth at NDVO as a friend of mine didn't had Birth certificate and used his SSLC front page alongwith an affidavit and he got his PR.

If you are in India, and your date of bith is before 1980, it is not that difficult to register your birth and you can get a birth certificate from your local Panchayat/Village office. ( local administrative office).
If your birth was before 1980, you don't need a report from hospital/ midwife/PHC etc.; An affidavit from your parents will do.
Most notary publics/clerks at Panchayat offices will be able to help you with this.
