Here are some important things to remember:
1. A spouse can be sponsored under the overseas family class or under the Spouse in Canada Class. These are two totally different programs and have different application forms. They also have different requirements. In the case of the Spouse in Canada Class your spouse must be in Canada and must live with you. In the case of the overseas family class you spouse can be living overseas or temporarily in Canada. Please note that if you use the overseas family class and your spouse in subject to an unenforced removal order then they must leave Canada before they can be landed under the family class (usually the visa office asks them to come in for an interview overseas).
2. Generally the overseas family class has faster processing than the Spouse in Canada Class. However you should always check the visa office processing times. Generally CIC will not issue a spouse a visitor's visa so they can enter Canada and apply under the Spouse in Canada Class. Therefore the Spouse in Canada class is usually used by persons already in Canada (like foreign students) or persons from visitor-visa exempt countries.
3. Around 20-25% of spousal sponsorship applications are refused, mainly because CIC does not believe the marriage is genuine. In the overseas class the sponsor can apply to the IAD to appeal that decision. However, you can easily wait 2 years for your appeal to be heard. Applicants under the Spouse in Canada Class DO NOT have the right to appeal to the IAD. They would have to seek judicial review in the Federal Court.
4. Because long delays can occur for your client if the case is refused or if an interview is required to determine if the marriage is genuine you want to make sure that your paper application provides as much information about the relationship as possible. Your goal should be to give the visa officer enough information that they can decide the case based on the paper application without an interview.

Hey yall's, Ive got some good news......MY HUSBAND GOT THE PHONE CALL TO DROP OFF HIS PASSPORT. I am so so so so psyched. Or Aniversary is April 23rd and hopeful that will be the day he lands. I cant say enough how being on this blog has helps my mental stated i thought id go crazy...............  . He drops off his passport on Thursday. |
