Good day. I am under the live-in caregiver program. My work permit with my current employer will expire 1st week May of this year. I have decided to transfer to a new employer. the new employer are still starting to submit for the LMO application. how long will it take for the LMO to process? I want to file for my new work permit but I still have to wait for the LMO result. do I still have time to renew my work permit under the new employer? thank you very much.

Hi,

Takes about 6 to 8 weeks to process LMO for caregivers if the employer did all the advertising and recruitment requirements of HRSDC. Average processing time for work permit application for new employers is 27 days.

I just learned today that the employer who is going to hire has to advertise for the job for at least 14 days. what about if it is the caregiver who has had the advertising? does it not count?

The employer has to advertise in the national job bank and a major daily or website for 14 days and prove that no Canadian citizen or permanent resident applied or qualified for the job.

thank you again job_seeker. my problem now is this. i am still working under my current employer. however since i planned to change employer, i did not renew yet my work permit which will expire this May. And I won't be moving in yet to the new employer until I get my new work permit with the new employer. Will it be alright if I will renew my work permit with my current employer and then later on just apply for a change of employer? i won't be questioned or the processing wont take even much longer if i just had my work permit renewed and then i will apply for change of employer? or while my work permit renewal is still on process, and the LMO arrives, can I submit another application for the change of employer then? I am trying to see which is the best option, wait for the new employer's LMO and then I will apply for renewal and change of employer or apply now for a renewal under my current employer and then just apply again later for change employer? help. advise.

You would have to withdraw your application before you submit another one.

For your new employer to advertise, and then apply for the new LMO, it would take approximately 10 weeks, if everything went smoothly, plus a week or two for the transmittal of communications. So there goes the three months. Then you' d have to submit your application which going by the processing time is another month, your present work permit would have expired by then. You just have to give your present employer enough notice (usually two weeks) before you start working with the new employer, or whatever stipulation on changing employers is on your contract.
