Hi, my husband is in canada on student visa.

can he call me as dependent?

he landed there before a month...

when can he put my file?

which docs of mine would be required?


Please guide me......

Is he a permanent resident?
Did he officially "land" as a pr or is he only on temporary visa?


I am not clear on whether Canada issues visa for study visa holders...perhaps one of the senior members can comment.

If he's there as a PR -
Were you married before the visa was issued?
Were you listed on any of the applications as his wife?
There's definitely rules on when a PR can sponsor someone...but again I'll defer to a more senior member.

If he is here on a study visa, it is only a temporary visa.  Either way he had to declare you as a spouse when he filed and showed up in Canada.  There is the option that you may apply for a TRV, to come stay with him, but...the chance is slim that you will get that. 

He should have claimed you as a dependant on his study visa when he applied or when it was issued if you were married.  You could have come with him if he declared you.

Pretty much you are stuck right about now, as he landed a month ago, and from my understanding he did not declare you as a dependant or spouse, which could in turn go against him as misrepresentation for not giving that information when he applied or was issued the visa, as you have to declare that information....

we got married after his arrival of visa.
i think it would be difficult in this case..

Other thing i want to ask is,

if i apply to for student visa and if i show my married status which docs of my husband i 'd require to show ??

Yes.  You can apply as his dependent.  You apply for a TRV at the embassy in your home country as a dependent spouse.  Search the embassy in your home country for the list of document required as it varies. You will have to show proof that you are married, proof of funds as well as ties to your home country.

You must apply from your home country unless you have been legally admitted to another country.  You can apply either for a study permit or open work permit at the same time or you can apply as a visitor and if approved, apply for the study permit or work permit at the port of entry when you arrive.

It is ok that you got married after the study visa was issued.  It is not a material fact to the application.  Processing times are as posted on the CIC website for study/work permits for the country where you apply.

You seem a little confused about how this process works.  You are "qualified" to apply as a dependent  and if you have plans to study you should advise the visa office of this with your application and include all of the relevant details/documentation.  So you are applying as a student and dependent at the same time.  They are not separate.
