Hi there,
             I went to canada as student from Pakistan in 2006 and filed my refugee case in 2009 and got rejected and was deported in Jan 2011.
Now i am in pakistan and i recently got married to a canadian born citizen.
    She came here to visit me and we got married.
                Now we are planning to file our sponsorship application next month sometimes.
My question is since i am here in pakistan and she is going back to canada and filing the application.

how long would it take to process the application and we are willing to settle in toronto city as my n her friends n her family lives in toronto.

           other question is when i was deported, The canadian Govt paid for my ticket. I wana know where we pay back the tickey money to the gov't.

Islamabad processing time is 26 months for 80% of applications, see here: http://www.cic.gc.ca/english/information/times/perm/fc-spouses.asp

You will be required to pay an ARC fee (authorization to return to Canada) of $400 since you were deported.  Any other fees, your wife can try inquiring of CIC or CBSA.

I think you will also have to pay back the ticket money to the govt along with the ARC fee.

At the time of processing or during processing, you may ask the Immigration Officer at High Commission or Consulate for ARC Application. They will give you a form. Fill up the form and submit with a fee of $400.00 (during my time in 2007).  The estimated time for approval is 3-6 months but sometimes it is done fast. If yous spouse who is a Canadian shows some urgency with Immigration Officer, processing may be done faster. But he has to take initiative.

You may pay the Air Ticket money to Immigration Canada in the form of a Bank Draft. Confirm this from Immigration Agent at the Consulate. .

There is nothing complicated. They will guide at every step.

i did refugee claim in 2006 it got denied, pro and humanity  application also got denied, then they told me i have 2 leave canada( under departures came deportation)..... but the officer told me whenever i need to come back i should have ARC letter + i have 2 pay air ticket....
now as i got married, m spouse is from canada..... here we r confused wht 2 do first, i mean ARC ,AIR TICKET OR SPOUSE APPLICATION....

Hi,

I was reading through canadavisa.com's pages about applying as a refugee in Canada. While quite a few of my questions about entering Canada as a refugee got answered through this forum, but I couldn't know much about the tested procedure for a Pakistani claiming as a refugee. I and my parents are currently being threatened and tortured by Sipah-e-Sahaba due to our religious background and due to our belonging to a religious minority. I have a few questions in this regard. I hope you won't mind spending some minutes to answer them:

1) How did you reach Canada? Were you on Canada's visit visa? Should I get a visit visa too and then claim as a refugee at the airport? Is there any other method (such as fake Canadian passport etc.) which would be better than coming to Canada through a visit visa?

2) After claiming as a refugee, is it 100% sure that canadian airport authorities won't deport me back to Pakistan? Would I need an immigration lawyer/consultant/attorney to file a refugee application on my behalf?

3) When filing for my refugee application, can I name or include my parents as well? so that when I be given permanent residentship (after my case/interview becomes successful), they are also given PR status in Canada.

4) I have read on the forums that after applying as a refugee, I can get work permit and study permit as well. The question is that, if I would be allowed to work full-time (40-hours a week) with the refugee work permit? Also, would I be able to afford my expenses through that job?

5) Do you recommend that I should bring my parents with me as refugees or should I bring them later (as I would have already named them in my refugee application).

Anxiously waiting for your detailed answers to my above questions.
