The following was my question :

Hi,

All my best wishes for those who already applied for their Spouse immigration and waiting for visa.

Brothers I have some confusion that I wanted to discuss with you, I am in Canada and about to apply for my wife sponsorship,  I have one doubt which I wanted to share with you.

Last year I got Nikkah but no “Rukhsati” and she is living with her family, in “SPONSORED SPOUSE / PARTNER QUESTIONNAIRE” IMM5490 we showed that we live together with my husband family, When she went for Medical they ask “Are you live with your husband” , she replies that she is living with her family but not her husband family.

Here is my question: Should  I change IMM5490 form to show that my wife is live with her family but not with her husband family.

Please advice, as Only Nikkah ceremony happened and I was planning to do rukhsati once she get Visa

Thats the answer:

 If you are applying through Islamabad there is a separate thread on the forum which you could join..I am in the same situation I have had nikkah but no rukhsati. Just be truthful if your wife is living with her own family then write that she is living with her family and not yours...it's better to make sure what you send is correct and inshallah everything will be fine the immigration officers are aware of the culture so its best to stick to what is correct and truthful.

I have an other question:

In Sponsored Spoused/Partner questionnaire form Question number 15 : "Was there a formal ceremony  to recongnize/celebrate the merriage" What should I write here? as only Nikkah is done but no Rukksati??? also Q No 27 " Have you and your sponsor lived togather?" What should I write here ?

Any suggestion will be appriciated....

1. if you had nikah ceremony then yes. expain where it took place, how many people were invited from both sides and so forth. and provide the pictures.
2. no ruksati so no. exaplin when you are planning to do ruksati etc

Well I sponsored my husband and I only had nikkah no rukhsati. So for this question I wrote that since being engaged in 2007 I didn't go back to Pakistan because I was studying and so was my husband. We had our nikkah done by proxy and are planning to do rukhsati and live together once he comes to Canada.

You will check "yes" and then describe the nikkah ceremony. For example we had our nikkah (legal marriage contract) on ______ in _____ , Canada (or wherever it was). Present at the nikkah were (write which relatives were there from your and your wives side). The marriage was performed under Islamic law. The total number of guests were ___. The imam (religious clergy man) performed the rites over the phone/ in canada. After this we distributed sweets/ food to the guests etc.

This is just an idea of the kinds of details you need to add in this section but it tells you what exactly you need to add in this answer.

You will write the members of her family with whom she lives. The immigration officers will realize that because you have only had nikkah she will most likely be with her family so put everyone she lives with. e.g. Mom/dad etc. They will understand as they are used to seeing these kinds of cases- just remember to be truthful with everything you put on the forms.

You will write NO. And if they ask why (I don't remember if they do or not) then you will just say that we have had our legal marriage contract and will be living together once my spouse comes to Canada. (Basically indicating you will do rukhsati once she gets here).
