Hi
I live in BC
My employer applied LMO so Im waiting a answer.
but My visa's gonna expire very soon I think I can't get the answer before my visa expire after then I don't have any visa
so can I overstay in canada untill I get the answer? or do I have to leave?
If I get a positive answer Can I go to a border for getting a workpermit? Isn't there any problem? even my original visa has already expired at that time?
I have no idea in my situation
please help me out the difficulty

I think it would be better not to overstay. I know of someone who also found an employer but overstayed. In the process of the LMO application, she received a letter from CIC that she has been overstaying and has to leave Canada. You could always complete your application at your country of origin for a new work permit, while renewing your TRV as well.

Point of Entry applications are only for citizens of visa-exempt countries. Check out:  http://www.cic.gc.ca/english//visit/visas.asp, if your country of origin is on the list, then you're not eligible for application at the border. You might be eligible for application at your regional office though. Check CIC and inquire.

Hi my LMO is still being processed (employer has to re-advertise for the role). My 1 year work permit expires December 28 so I plan leave Canada and go home for Christmas. If I return after it expires can i re-enter on a holiday visa and wait until the LMO has been approved?  How significant is the risk of not getting back in?    any advice appreaciated, thanks

What all of you guys don`t know as I read you, there is a new policy carried out this year. Someone whose work permit is going to expire in 2 weeks or less can submit an application for extention without the new LMO. You need to submit the application for the LMO and the confirmation number that your employer got, when and where it was submitted. In this case once they process your application CIC will contact HRSDC and ask for the LMO. By that time it has to be done as the average processing time is 90 days on paper, 50 days online. This way you can continue working on implied status while waiting on the decision and you do not have to leave the country. I wish that all foreigner workers would know about this policy as it makes a huge difference when someone is waiting for an LMO to be processed. If anyone need more information or the operation manual about it, PM me.

I attached the e-mail I asked to be sent to my e-mail address. So as you can see, it is an existing policy. I applied for my WP extention this way and they did not return it. If I remember correctly this was carried out after Sept. 2010. It is nowhere to be found on CIC website, it should be accessible to public. Hope, it is helpful.

Thanks. This certainly is helpful to those whose whose work permit are expiring and are still waiting for LMO. You're right. It should be made public; made available on the CIC website.

i read about this here http://www.cic.gc.ca/english/resources/manuals/bulletins/2010/ob152A.asp towards the end of the page under "Additional details regarding concurrent processing" subheading...


"For inland processing, the concurrent processing option will only be allowed for foreign nationals whose work permits will be expiring within two weeks. They must provide proof of a valid job offer, as well as proof that the employer has submitted a request to Service Canada for a new LMO. Applications will be initialized and the processing fee will be processed. Applications will be held for two months (TBC for CAQ) from the date of receipt, after which a determination to either refuse or approve the work permit will be made."
