Hi,
My ex left me 2 years back and since then I had no idea about her whereabouts. I applied for divorce in Pakistan and she appeared in the court to contest the same. She is just trying to give me hard time and may be extort some money through alimony. No kids involved. The court process is still going on. Meanwhile I moved on in life and have a common law relationship in Pakistan with my partner for over a year. We have sufficient evidence to prove our relationship and I also have divorce documents that I have filed in the court. The divorce process is taking too long and I do not foresee a sooner ending. I sponsored my ex three years back. I now want to sponsor my new partner under the common-law class. Will my sponsorship application be approved or will I face any roadblocks?

You can not sponsor another spouse until it has been at least 3 years since your first spouse landed. Maybe they will look into your case a bit more closely as a habitual sponsor of spouses but if you can prove your relationship, I don't think you have much to fear.

Thanks Leon, yes it is already more than 3 years since my ex landed. Also, it has been 2 years of physical separation with her as she left me. There is no separation agreement in place as she did not co-operate in it and as I said she just wants to give me hard time by not giving a divorce. And the only reason for me to go behind the divorce was to get things cleared so that I can marry my new partner. Now we have given up on the divorce process as it is taking too long. So, we thought of going thro the common-law route as we meet all requirements for common-law sponsorhip.
So, if I just produce the divorce application I made along with the court proceedings and prove that the marriage has broken down and also produce strong evidence of my new relationship - I should qualify to sponsor my new partner right? I am not a habitual sponsor but just that I fell into the wrong companion and that has let me down all these years. Now, I have found my true soul mate.

Right, as long as you can prove that you are separated, seeking divorce and have been living with your new partner for at least one year, you should be ok
