Mistake in marital status of sibling

My relative received her PR card 2 years ago. But when she applied for canada immigration 2 years ago she made a mistake for her brother's marital status in additional family information. She has 3 brothers. 2 of them are married and one is single. But when she filled the form she said all of them are married.

Now she is sponsoring her single brother. She is wondering

1) Whether the CIC will refuse her brother application because of her mistake of marital status of his brother?

2) Whether it will affect her PR status anyway?


3) If she wants her parents to visit Canada, whether it will be a problem?

Hi,

1. She has signed the declaration at the bottom of the IMM5406 ( Family information) that :

"I certify that the information contained in the document is complete,accurate and factual. I also realize that once this document has been completed and signed that it will for, part of my immigration record and will be used to verify my family details on future applications."

CIC decide how to deal this omission.

2. Don't think so.

3.Parents can visit, no problem if they get TRV

Should she at least apply and try for her brother's immigration if it does not affect her PR status?

The wrong information submitted in the form was  un-intentional. The applicant (your sister) does not gain any benefit  by hiding the fact. But logically, it is definitely a mistake on her part. Therefore, my assumption is that she may be able to get the sponsorship  done. If an explanation is asked by CIC about  giving a false information, she can apologize and request for pardon for her inadvertent submission of particulars about her brother. But I can't say whether there could be any adverse impact on your sister, when she submit the papers.

There could be different expert opinions.

Can someone with more experience please answer:

Will CIC deport her if CIC knew that there was a mistake in her brother's marital status? Please note, she didn't gain any point in her application for her brother. Hopefully it does not mean misrepresentation that can induce an error in her immigration file.

Should she talk to any immigration lawyer? Anyone one knows good lawyer in Canada?

This is a case of a MISTAKE, not MISREPRESENTATION.  The sister gained no benefit and the brother's marital status was not a material fact of her personal application for permanent residence.  So NO, they won't deport her.

You state that she is sponsoring her "brother" but don't make mention of the parents.  She knows she must sponsor her parents as well, correct?  And that her brother must be less than 22 years of age and a dependent of the parents?  When she submits the complete application she should include a cover letter indicating the mistake she made on HER application for permanent residence and that her brother is not and has never been married.  If they want more proof later (no marriages registered), they will ask for it.
