Is misrepresentation a grounds for inadmissibility for filing H&C or trying PRRA?
Yes i misrepresented in my refugee claim and got accepted,but its been fund out and i have a vacation hearing soon.They know the truth and all my original docs that i hide is with them(CBSA)
I have 2 kids born here,can i use them as interest of them to apply for something else or just let it go?

If your refugee status is vacated for misrepresentation, then there is no appeal under 64(3) of the Act. Your only hope would be at a PRRA. |

I want to consult a lawyer but the cost involve is a heavy duty and if i know from others who have gone through this that there is no hope then i will not waste the cash but keep it for my departure.
Now,under 64.3 i cannot appeal.
What are my chances on PRRA?can i use my canadian born kids as a subject?will PRRA accepted for the interest of them?If status is vacated,how ling does it take for removal order to take place or voluntary departure?Vacation hearing is scheduled in 1 month.
What if i want my wife to file a claim that she cannot return because i am abusive,and fear what will happen when we return?will that help her stay at least with the kids?
I will love that my wife stays so my kids can school here,besides i can get a job back home but my wife may have hard time.
We came from Europe (Holland)with EU passports that was hidden but has been found and.We did not disclose our EU citizenship during hearing but we claimed to be from Eritrea.
Any tips?

Why the heck did you want to flee Holland??...all those lovely tulips..and clogs...
No sympathy here I am afraid...I have zero tolerance for those that try and abuse the system, especially those that already come from a very wealthy safe society.
Applying for PRRA is just another abuse of Canadian tax dollars.

Clearly the OP has no problem with that sort of abuse. No matter how long I think about this sort of stuff, I doubt that I will understand why someone abuses the system and then wants it to support them. |

If my wife file that i made her lie and that i said is she does not lie i will abuse her,will that help her stay whiles i leave becos i really want her to stay with the kids and i dont care if i quit.

You got bad advice - you are joking right?
Claiming to be a refugee, when you are not, is not a mistake it is a deliberate act.
It seems that no matter how much you want to "use" others to stay here, you are going to be leaving Canada.
What on earth do you think you are teaching your children, lies, cheating, deception and fraud are all OK??
FWIW Another lie will be likely to make matters worse.

i agree with you and i will be honest to tell cbsa that i want to return in good faith.
I will then write an apology letter to Canada and leave willingly.
I am ready to but if the wife is allowed to stay then so be it.

What in Holland could POSSIBLY be bad enough to justify abandoning wife and children here? No matter what kind of job she does, raising children alone is expensive and difficult - I did it for many years (in Canada) and it was very, very hard. At least in Holland she would have her husband to share the load.
