Oh great! We actually applied back in 2009 originally but we were denied because I did not live in Canada. At that time, the did send the application for PR to Buffalo, New York. But now they send it directly.
Were you denied because you were a permanent resident and not a citizen? I am so happy to hear they send it directly now! That saves us time!

Well thank you, that is very helpful. We will definitely book a return flight even though he probably won't use it. Still a bit risky but also worth it as we will basically be camping in our house after our stuff leaves for Toronto! LOL! I was planning on flying out of LAX with the baby but maybe we will fly out of Mexico too so I am at customs with him. We provided NO proof in the visa application that he would leave Canada when it expired. I just wrote a letter saying I anticipated he would get his PR card before expiration and showed a copy of his first PR. Haha! But now I see that our chances are slim. Supposedly it takes a week for them to decide so I will post and let you know.

You honestly never know though, people didn't think my SO would get a multiple entry visa and he did so it just goes to show that you never know the outcome.

Hoping you guys get it!! Smiley

No interview + fast approval = fortunate
Yes that is true. Sorry I thought maybe you knew something that would affect our second application - like they had made a (good) mistake with us the first time!

I say it'd be a huge gamble to cross into Canada with the TRV assuming he is granted one to begin with, Canadiangirl.
There are no ties to Mexico and if he's sent back to the US, I doubt they will allow him in!.
Not to sound pessimistic or anything negative. I would wait the process in the USA.
Best of luck.
I appreciate your advise. I think we will probably not attempt to use the TRV if we get it because of the gamble. If we didn't have the baby it wouldn't be so bad but I don't want them separated for who knows how long. Plus he would have nowhere to go in Mexico really.

No. USA.
But if he is denied entry he won't be allowed back in the US since he is undocumented here and will have to be in Mexico, where he has no real ties.

We were denied because as a permanent resident, I must reside in Canada at the time of applying. Canadian citizens do not have that problem. They can be anywhere and sponsor their spouse. I actually moved back to Canada for the express purpose of sponsoring my husband. It has been a challenge being separated but we are fortunate that it is only a 8 hour car ride for me to go and visit him (once per month). Hopefully things will be processed quickly and we will reunite in Canada soon!

I see. Well I hope you get your visa quickly because it is hard to be apart. 8 hour car ride isn't too bad but you will be so happy to be together!

How long is the application process for Mexico? CIC says 13 months, is that what everyone here is reporting?

As far as I know, you must be officially divorced first in order to sponsor your new common-law. But what does your lawyer say about this?.
Also there's this "Authorization to Return to Canada" when someone deported can apply for.
Best of luck.

Our lawyer says that this is fine as long as I am able to prove I have been legally seperated for more than a year and have initiated the divorce process, my ex husband and I have been seperated for almost 4 years now and the divorce is 80% over. I will most likely be divorced by the time his ban from Canada is lifted. We have decided to go ahead with gettting married since sponsorship seems like a much larger under-taking then marriage itself, so we plan to be married before his return to Canada, fingers crossed for next fall if all goes well.

Congratulations on the upcoming wedding!!!!!!!...
Yes, I think it's the best (being oficially divorced and then married) to eliminate complications with the sponsorship.
Best of luck!. Any help, please ask (although my process was inland).
Rob.

Thank you Smiley We are very excited about it, especially the opportunity for our families to meet in person Smiley Oh and I guess we dont need the ARC because his time limit will have expired by the time he gets his PR, at least thats my understanding, however he does have to pay back the airfare that was paid when he was deported, but all worth it in the end !
