Hmm, interesting. I didn't know you could apply at one visa office and ask for an interview at another.. Canadiangirl, what year did you apply for PR for your husband again, 2010?

Well I don't know if you can. We put Los Angeles but it didn't matter because they didn't want an interview. If they had wanted an interview, I don't know what would have happened - they may have told him he had to go to Mexico City. Although thinking about the form, there were only US cities on there. But maybe that form wasn't the right one. I didn't even see an interview request form when I did it this year.

Our first application was received Jan 20, 2010 and a decision was reached on April 13, 2010.

Hi all,

Just to share my understanding and situation:

My hubby is undocumented in the U.S. and I am a Canadian Permanent Resident. Since I am not a Canadian citizen, our lawyer said that we are required to do two things, given our situation: 1. I had to be physically present in Canada at the the time of applying for sponsorship and for the duration of the application process and 2. Instead of applying through Buffalo, USA, we had to apply through Mexico City visa office since hubby never had legal status in the U.S.

Now, the caveat for #2 is that if they call my husband for an interview in Mexico City, he must leave the U.S. to attend the meeting.
Thanks for sharing! Hopefully no interview is required.

We also chose Mexico City as our visa office but it still went to Buffalo first since his address was in the US. Then they forwarded it to Mexico. I wish it could just go straight to Mexico because that would save time.

Here is our story and I am curious if anyone else has had a similar situation and how the process went for them.

We met in Canada almost two years ago now, he is mexican and I am canadian, we fell in love and moved in together, also have a daughter that has also fallen in love with him as a step-dad. He had  been living illegally in Canada at the time, so needless to say we were always in fear of that phone call that he had been picked up. Last August they arrested him at our home and deported him almost emediately. We did very well at the hearing but they had already purchsed a plane ticket so we got him out on bail and spent our last few hours together as a family, a very tramatic experience for all of us.

We have since retained an immigration lawyer that seems to think we have a very good chance at having him come back with us, we have collected as much proof as possible. We didnt have anything joint as he was illegal, so that is a bit of an issue, he wasnt even on the rental agreement. However we have letters from neighbors confirming his residence, letters from both sides of our families, pictures, phone records, skype records and travel records (me traveling to visit him in mexico).

We have gotten everything together, police certificate, medical, all his identification for both him and his daughters, all my required info as a sponsor ect and are just about to submit it all for processing via our lawyer.

We are hoping that he will be back with us by December, but of course the immigration wheels move slowly, so who really knows. What is everyone elses experiences, my biggest worry is his illegal status and being deported. he had a one year ban which will expire in August. I guess the other thing to note is I am still married to my ex husband (Seperated 4 years) and am in the process of divorce (hopefully to be finalized soon) has anyone else been  in this situation ?

We have applied common law, but wonder if once my divorce is finanlized if getting officially married will help our chances of having him come back with us or if it is really necissary....

As far as I know, you must be officially divorced first in order to sponsor your new common-law. But what does your lawyer say about this?.
Also there's this "Authorization to Return to Canada" when someone deported can apply for.

Yeah it just seems weird b/c usually the embassy dealing with your case has further questions about your relationship, hence the need for an interview.. which is why I thought it was weird since it would be Mexico city embassy that had questions, not the embassy in the US.

Since there are some people online who are so knowledgeable, can you help with my temporary resident visa question? I sent in an application on Wednesday, not having found this forum yet and thinking he was a shoo in since my daughter and I were moving to Canada. Oops, I may have wasted that money. But say he DOES get it since they see he was granted a PR in 2010. Should he attempt to enter Canada with it or is it likely they will reject him as he has no ties in Mexico? We don't want him to end up stranded in Mexico since he cannot return to the US. Thank you SO much.

Oh well there is no question about our relationship being legit. I had so much proof in that application there was no need for an interview, LOL! I had engagement photos, wedding photos, reception photos, honeymoon photos, letters and emails written between us for several years, etc etc.

That was for the first application in 2010. It went to Buffalo first. If it goes straight to Mexico now that is great! I just mailed it two weeks and one day ago so there is nothing when I check the application status.

Oh also - we didn't expect it to be that fast! At the time, processing was estimated at 12 months if I remember correctly. I will say that my paperwork was very organized but I am sure those who work with a lawyer have even better paperwork so maybe I was just lucky.

If he actually obtains a entry visa, I doubt they will ask anything    @    customs (I have researched this a million times, my SO has entered twice on his TRV, most recently together two days ago when we returned from Mexico!) Just bring proof you will be applying for PR, go through together, talk on his behalf and say in case anything happens you will support him, make sure he has an return ticket to Mexico, just in case.. it is highly unlikely they will ask though, especially the first time entering the country.


P.S I drove my poor friend itscoezy crazy about that! hehe, what would I do without you!

Oh great! We actually applied back in 2009 originally but we were denied because I did not live in Canada. At that time, the did send the application for PR to Buffalo, New York. But now they send it directly to Mexico City.

I say it'd be a huge gamble to cross into Canada with the TRV assuming he is granted one to begin with, Canadiangirl.
There are no ties to Mexico and if he's sent back to the US, I doubt they will allow him in!.
Not to sound pessimistic or anything negative. I would wait the process in the USA.

Well thank you, that is very helpful. We will definitely book a return flight even though he probably won't use it. Still a bit risky but also worth it as we will basically be camping in our house after our stuff leaves for Toronto! LOL! I was planning on flying out of LAX with the baby but maybe we will fly out of Mexico too so I am at customs with him. We provided NO proof in the visa application that he would leave Canada when it expired. I just wrote a letter saying I anticipated he would get his PR card before expiration and showed a copy of his first PR. Haha! But now I see that our chances are slim. Supposedly it takes a week for them to decide so I will post and let you know.
