How long does it usually take to get AOR from Mexico City after it has been approved in Misissauga?
I was approved as a sponsor on January 31st and we havenīt heard anything from Mexico since then.
Is there anything we could be doing now to get ready for whatever comes next?

Correct me if I am wrong (mrs.romero and others) but if your spouse if illegal in the US, I think he has to return home to Mexico where he has actual legal status while applying for PR.. This is what I remember reading, maybe someone with personal experience can chime in..

Hola, Americana. Reading the webpage, the lawyers seem to be saying that being illegal is OK with Canada and the applicant can file " in the country in which the applicant is currently residing if (i) the applicant has at any point in the past lawfully resided in that country for a period of one (1) year or more ..." This I remember from when I was considering my own situation back in 2010. Basically, if you didn't at some point have status for at least a year, then you can't file and you must file in your home country. Does this make sense, people? I'd love to be wrong about this, but for that and other reasons, I actually went home and did everything from there.
Heres your answer Canadian girl, so I guess it depends how your husband entered the US that decides if he can wait there, am I understanding this right?

Exactly. Best to confirm it with a lawyer though. As we've been saying - times, they are a changin'; and the information that Nafta and my husband relied upon at the time they applied may no longer be in play.

Nothing has changed yet, but I think Islenio's point is that things are changing in the immigration system.. they are talking about two year conditional visas (similar to the US) for spouses of Canada. That's all I heard, nothing has been implemented yet. The average wait time right now is 6 months if you pay the right of landing fee right away, but depending on how complex the case is, the wait can vary.

Hi and thanks for the info! I do have personal experience with this. We already got a PR visa in 2010 but had to let it expire because we couldn't move. Everything was processed in Mexico but he was in the States the whole time. He would have had to go to Mexico to fly to Canada although he could have driven I suppose. But he didn't step foot in Mexico and he got the visa in his passport. We are expecting the same this time because I have not read otherwise.

Yes the visa must process at the Canadian Embassy in Mexico but you don't have to live in Mexico. My husband was in California the whole time and had been undocumented since he was a child. We mailed his passport to Mexico and they sent it back with the PR visa in it. But we had to let it expire. Sorry for the repetition as I mentioned this in a previous message.

Yeah, were not talking about actually living in Mexico (my spouse is here and will wait with me here in Canada until he gets PR, he has a multiple entry visa and we are applying outland to Mexico City) What they were talking about is that for example if your husband entered the US for a study visa for one year, then let it expire and stayed.. he still had legal status for one year, making him able to stay in the US while his visa for Canada is being processed.. if he EWI'd it's different.. that's why it was suggested to do a consultation with a lawyer to make sure nothing has changed. You already went through this and he was able to stay in the US (which is awesome) but its always good to double check if things have changed because you don't want to create further delays in the application! (just my opinion) Good luck!

Your husband was very fortunate.
Why? Nothing in the application process ever said he needed to reside in Mexico. They just said they forwarded his application to the Mexico office. Of course if he was called in for an interview he would have had to go although nothing ever specified that the interview couldn't take place in the US. We requested Los Angeles for the interview. And looking back, we got the visa in less than 3 months. Sheesh we were lucky! Of course I have a bad feeling it won't go so smoothly this time but we will see!

I am a little slow with the lingo so I don't know what EWI means. He was never legal in the US, not even for a day. I wish that he could go to Canada before getting the PR that is for sure. I went through the paperwork with a fine tooth come and read everything on CIC and I see nothing different. Crossing my fingers! I have never consulted a lawyer. But canadavisa.com has been very helpful!

Hi all,
Just to share my understanding and situation:
My hubby is undocumented in the U.S. and I am a Canadian Permanent Resident. Since I am not a Canadian citizen, our lawyer said that we are required to do two things, given our situation: 1. I had to be physically present in Canada at the the time of applying for sponsorship and for the duration of the application process and 2. Instead of applying through Buffalo, USA, we had to apply through Mexico City visa office since hubby never had legal status in the U.S.
Now, the caveat for #2 is that if they call my husband for an interview in Mexico City, he must leave the U.S. to attend the meeting.
