Please help us. My Fiance wants to go home so that he can go through the process to come back to canada as a skilled worker. He came to Canada legally 3 years ago. He lost his passport about a year ago now. The Mexican embassy said that he needs to report his passport as lost. But what will happen if he does that? How can he go home legally? Will he just need to turn himself in and be deported? Will there be a price to pay?

Someone please help!!!

He needs to go to the Mexican embassy, report his passport lost and get a new one.

We went to the embassy, they will not give him a new passport untill he reports the lost one to the canadian police. Is that going to be a problem? Wouldn't they just deport him? His passport would now have been expired.

So he is illegal now?  Maybe he will get deported if he reports his passport lost but that it the only way he can get a new one, he'll have to do it.  If he tells the police he is reporting it lost so he can get a new one so he can leave, maybe they will just let him leave.  If he's illegal now, whether he is deported or leaves on his own, when he applies again to come back legally, they will know and it may affect his application.

Yes he is illegal now, but he did come here legally to compete in a skateboard compition and just decided to stay. Do you know what the conciqunces will be? Will he even be able to apply to come back to Canada? Thanks for your help. Much appreciated.

I really don't know if they will ban him for a couple of years for overstaying or not but it will always be hard for him to get any kind of temporary visa again if he overstayed before.  At worst you could marry him and sponsor him for PR but before you do anything, you should talk to an immigration lawyer to find out what is best to do to minimize the consequenses.
