With The two new rules Kenney wants to Implement

Its not whether we will get the Visa or not the Question is WHEN

Last weeks discussion of battered NOC List some how does not feel unfounded since yesterday

Dont you think that If by case, they treat our files same as pre 2008, they might loose those valuable immigrants who might plan to apply? Also the other nations eye on Canadian immigration system and by chance UN minght come in picture for such injustice with us. May be

I personally feel that the files who are in IP or verification calls or with MR are in the que to get visa. I think thats what they did with pre 2008 as well. They may get delay for sure, but not cancelled like 2008 onces.

Even the current process ensures speedy processing for the Applicants with NOC's on the priority list and they were put in que after the M3 & M2.Now I guess once these proposed changes are put into acttion the seniority will reverse ie: MI2 & MI3 will be on Que after MI1,which i think , is the way it has to be.

UN would have no business in these issues. But it seems that there will be some court proceedings if they officially get away with the Pre 2008 Applications and that would prevent CIC cancelling the MI1 or MI2.

Regarding the abolition of Pre 2008, Remeber it is just a proposal and has not been implemented officially (though the vO's stopped processing those files)IMHO-Once it is officiated, VO's would try to finish off the then pending list ie: MI1 & MI2, so that then they would only have to deal with the working inventory. In other words it could also mean that then it will be a process of elimination rather than selection and also the selected ones would have to swim through a period of uncertainiity.

But i guess VO's are fully on their process of reviewing all the MI1 files by June 2012.My consultant in Canada communicated that they are expecting some feedback on our files with in next few weeks. though he is not sure whether it would be a positive one.

I wanted to bring your attention to a news release from Minister Kenney's office yesterday:

http://www.cic.gc.ca/english/department/media/releases/2012/2012-04-17.asp

It basically suggests that the new  guidelines for FSW applicants about to be released would have a new point system, with emphasis on younger applicants, with high education credentials,  and very high reading and writing skills in English. They must also be in NOCs that are in great demand, meaning they can get a job immediately...

Here is my concern, the news release states:

"change would allow new regulations, once approved, to apply retrospectively to people who have already submitted an application. "

This would mean that the new point system and its requirements would apply to all those who have submitted applications in previous years as well, in effect thousands of applications will be denied because they would not qualify. Only the few, with the above mentioned qualifications, will get through.

The red part is a matter of worry

Today, Minister Kenney announced two additional changes that will help transform Canada's immigration system. One proposed change would help CIC ensure FSW applicants meet current labour market needs. It would allow new rules set out in Ministerial Instructions to apply to people who have already submitted an application. For example, instructions could place a priority on a specific occupation, such as doctors, and have existing applications from doctors processed first, regardless of where they are in the queue.

A similar change would allow new regulations, once approved, to apply retrospectively to people who have already submitted an application. These changes would help ensure that immigrants are chosen based on Canada's current needs and priorities.

How can they apply rge bew regulations retrospectively to people who have already submitted an application, the situation seems to be getting worse by the day... what will happen to all the 0111,1111 and 4131's from NDVO who are already "In Process"

I received my CAIPS report today. It says

PSDEC:  1  (Done on the same day that my In process changed to the date)
SELDEC: 1  (Done on the same day that my In process changed to the date)
Points awarded: Age:10, Experience:21, Education:25, Language:14, Adaptability:5
Total: 75
BFD date is 01-06-2012 (Exactly 4 months from the date of In process)
IO comments:
PA has obtained sufficient points to satisfy me that he/she will be able to become economically established in Canada. I am satisfied that the points awarded to the applicant adequately reflect the applicants ability to settle in Canada.
PROOF OF SETTLEMENT FUNDS - MUST BE RE-CONFIRMED (This is in upper case)

ECU Please request the following:
- updated proof of funds
- PPT's
- Meds
- RPRF

Though I have sent my RPRF along with the documents and I have a receipt of the same, still the IO is requesting the ECU to request for RPRF. Also, RPRF received is mentioned in the CAIPS report. Also they mentioned that they sent me a receipt for RPRF.

With inprocess dates, we are on track. I hope, nothing to worry about backlog etc. We will reach our goal soon.

Let us be positive here,

It means that the previous applicants who would still meet the new guidelines would be given preferences irrespective of their time of Application..But that doesnt mean that all the other applicants would go down the drain.

Assume this ! with caps on 29 NOC's the max intake is for 12000 Visas and max ND can have 4000 applicants on this.
ND is having 8000 visas for this year...so guess the ballance would be for the previous Applicants.Yes it means More waiting

Whatever said above is purely out of my Optimistic thoughts and my belief on the Canadian System.
It seems that there is lot more than what is announced. There could be many other facts which can be infered from the Ministers recent continous press releases.

I really hope that he wouldnt throw the baby out with the bathwater !

So it means that applications sent before will be rejected if they dont meet labor market needs in Canada or are not included in the NOC?
Then, what does this actually mean?
Today they submit a new list of NOC in need in Canada..........processing times take God knows only how long (6-20 month) and suddenly during this period needs are being changed in Canada after such a long time waiting. Moreover, they send letters that processing will take 9-12 month........but due to some reasons processing is being delayed and during this period again you are being appeared in a foolish situation and become a victim...Peopleeeeeee   it's not reasonable and seems too anfair.
This is not an explanation......then why are they delaying the process and  then say that now your NOC is out from the list ..........bye bye

Please, tell me..................is this fair?  Embarrassed  Embarrassed  Embarrassed

Dont worry friend,
You are a bit lucky that you can follow your ecas online, in my case I am not able even to follow my ecas from the very beggining of the process. I wrote a letter and they replied that my file is in process and has been reviewed by visa office.
It's normal.......you can write a letter to your Visa Office.
You can use the site below to get e-mail address or phone numbers
