Hi every1...my name is Manpreet and i am an international student currently studying in sheridan college. My gf is in India and she is eligible to apply for PR under Federal Skilled Worker but for 2011 applications are already filled. I want to ask you can she apply for PR under Skilled worker if she came on student visa and drop her studies. and what will be her status if she get married to me on student visa and dropped her studies???..Plz do reply i really need dis info...thanks...

According to me...

1) If the quota for the year is full ... then it is full! Whether student or otherwise, no one can apply for that year under that NOC.

2) If she applies next year / when the quota opens again, she can apply for FSW even if she is in Canada -please note, experience in the feild is required (besides other qualifications) and if she drops her studies she could drop her student visa too.

3) Another risk, you are assuming that the next year, the NOC she is applying under will be present, and getting her to Canada under that pretext.

4) Your wife can work while you have a student permit ... read about it here.

Best thing to do .... wait for the quota in July and apply, it takes a max of 15 months and this way there is no ambiguity. Good Luck!

4) I am unsure about this - although the form for temp visas (worker / student / visitor) has a column for spouse / common law partner, I do not think a spouse can accompany a student on his / her visa.

Thanks for the reply. she falls under Registered Nurses(RN) and as far as i think NOC will remain in July 2012 also. I just want that she came here early and after reaching here apply for PR under FSW. Is this feasible??

For all practical purposes "YES"

She can come here and then apply under the FSW program.

If she stops her studies her visa may get revoked. You can get married to her (which I assume was the initial question) and get her here as your spouse. She can work while you study and apply for the FSW provided she meets all their requirements.
