 Hi,
could anyone please help, its rather trivial question, but still I am not sure!
Me and my partner whos sponsoring me, should we fill out in the forms our marital status as "single" or "common-law" Huh Grin

Have you lived together for at least 12 months?  If yes, then you are common law.

Yes, we have. But I am confused just because I thought oficial marital status can be only 'single' or 'married'. Since Im not coming from an English speaking country, we dont have legaly recognized a common-law partnership in my country, that's where is my confusion coming from.

You are to fill in the forms based on how your relationship will be recognised in Canada, NOT your home country.  So, if you qualify to emigrate as a Canadian's common-law partner, that is your status.

'Provide the date on which you were married or entered into the common-law relationship'


Is that a date we have been declaring to live together (as this is the prove of common-law)? Or is that the date on the Statutory declaration of common-law union IMM 5409 Huh  Huh

The date you started living together as common law partner. The Statutory declaration is a legal proof that CIC wants with both of your signatures on it on which you will declare (under oath in front of a commisionaire of oath) on what date you started living together in a genuine loving common law relationship and still continuing so..

Better have other documnets also that will prove that you started livng together on a certain date to make your application credible..

I guess the only situation when anyone would check off "single" is a conjugal partner relationship?? (I.e. when there's a valid legal or immigration barrier to living together).  

However, the logic of spousal sponsorship suggests that you can only be "married" or "common-law" in order to be eligible...
