- please advise me what to do now, is it better for me to find another employer under live-in caregiver to extend my status or it's better to apply an extension of stay as visitor while waiting for the result of my inland application?

- im waiting for last week of may to pass my extension as Im waiting for the renewal of my passport.


Issues:
1. my passport will expire on july 02, 2011
2. my work permits under live-in caregiver expires on june 30, 2011 ( i stopped working after 25 months of working and after marriage)
3. my application under inland spousal sponsorship was

   - received on september 15, 2010.
   - they start processing on november 3, 2010

4. i renewed my passport and they will release in may 24, 2011 (too long to process! )

I don't believe you can apply to extend your live-in caregiver status if you are no longer working - but, considering the fact that you apparently did not submit the extension application WITH the inland PR application anyway, it makes no difference.  

It's advisable to include the extension application WITH the inland PR application so that, when they go to assess first stage approval, they know that you have valid temporary status.  As long as you submit the extension ap and the inland ap together - before your temporary status expires - you're protected to remain in Canada under "implied status", no matter how long it takes them to process to first stage.  If, when they go to assess you for first stage approval, it appears that you no longer have valid temporary status (because you did not include the extension application with the PR ap) they will transfer your inland PR application to your local office for special handling and that can cause significant delays in processing your application AND your first stage approval.  At this point, because it's taking them up to 10 months to get to applications to assess them for first stage, it's a gamble whether they will get to your application before your status appears to have expired.

My suggestion would be to mail a hard copy of the extension application (rather than applying online) to CPC-Vegreville with hard copy proof of the receipt of your inland PR application having been submitted.  A copy of the tracking receipt with the date the inland ap was received by CPC-V is best, as you won't have received any confirmation of receipt from them yet.  Write across the top of the extension application: "INLAND SPOUSAL PR APPLICATION SUBMITTED SEPT 15, 2010 - DO NOT PROCESS UNTIL FIRST STAGE APPROVAL".  This sometimes helps to alert them that you have a PR ap in process and they will try to match the extension ap to the PR ap.  Another thing you can do - because normally you would not be eligible to do this without an inland PR ap - is apply for an open work permit, rather than visitor status, with your extension.  That should get their attention, too.  The gamble to that is that, if they don't match up your inland PR ap with your extension, they cannot approve the OWP, and then you'd get denied new temporary status.  So it's probably safer to just apply for visitor status - still with the disclaimer across the top of the ap - and wait until you have first stage approval to apply for an OWP (if you want one).

thank you so much robsluv. that was so helpful. I think im gonna follow your advice to extend my status with visitor's visa.


I feel so sad that i didn't include the extension of stay with the PR application. I thought when I ordered the whole application package online,that's the only thing to comply. but it's too late now..

anyways, I will submit my extension of stay end of May so I still have around 50days before my permit expires.

You didnt have to apply for extension when you applied for PR because you already had a status. So dont worry:). Just apply for a visitor extension, as long as you mail it off before your expiry date, you will have no problem.

thanks a lot coldgirl.. i know i worry too much..

yeah, i just pass my visitor extension next month then I will follow robsluv advice too to attached receipt of the sponsorship and the tracking number for the application for them to tally the application.

also, i need to update them my passport and my husband's passport as they are about to expire now (we just got send renewal for both)
