Hello,

I work for an Ontario based Design company, and i would like to extend my current work permit. My company already received a positive LMO and I have to apply for my work permit now. And here is the point: However, I would like to work for a different company. (I already received a job offer from the different company)

My question: Can i take my LMO with me and go to a canadian border and ask for a work permit for a different company? Or in other words: Is a positive LMO transferable from one company to another?

I appreaciate any help, please ask me if you need more details.

No - LMOs cannot be transferred.

If you would like to work for a different company, they will have to apply for a new LMO.

No chance to transfer a LMO even when i go to the borders?

Hi nangnag,

Scylla is absolutely correct in his suggestion.

LMO is generated by HRSDC on the request of an Employer for an individual having a particular address which cannot be interchanged with anybody. In other words, LMO is employer, address specific and time specific

HRSDC does a lot of work to approve this LMO, which includes investigation of the employer for salary, # of other employees working and most importantly, if the job being offered had been properly advertised to check the availability of Citizen or PR holders. At POE, the Immigration officer might check with the Employer (by phone) if the job is still available or not.

When you have already received the Job offer from the other company, why dont you process the WP formalities for that company?

I am sure you already know the process of HRSDC approved LMO ....I have included the additional information for the benefit of other members...if they required.

Yes - that's right. The new employer must apply for a new LMO (including advertising the job first) and this means there will be another wait.

What mitali meant was that you will have to go through the same process with this new employer (i.e. new LMO - then new Work Permit) that you went through with your first employer. So you must already be familiar with the process having done it once.
