Applied for LMO middle of October. LMO recently received. Looks like it was issued at the end of November.

That's a short processing time... At least not 12 weeks. My company is reapplying in a few days.

Guys,
I think my employer is not paying me as much as they claimed to the CIC.  What are my options?
I know my post LMO annual income because of an internal document that they asked me to verify before sending to CIC.  Now, they say that the document was for internal purposes only and I should not expect the salary mentioned in that document.   THe company or its lawyers are not ready to tell me what income was claimed in the documents they sent to HSRDC/CIC.

I know I can call up the CIC number and tell them about this "fraud"  but I want to be absolutely sure before I do anything.   How can I know the salary I am supposed to get?

Hi there,

I applied for a new work permit with a new employer on Dec, 7th, 2011 and mentioned my new employer has applied for one, but has not yet received it. My new employer applied for positive LMO on Nov, 9th and received a file number from HRSDC on Dec, 13th. Almost 2 weeks ago my new employer call HRSDC and they declared they are still working on the October files this means more than a month they need to issue the positive LMO. Now my questions:

1)What will happen if CIC reach to the decision point on my application (probably last week of January 2012) and still I don't receive the positive LMO?

2)Now I have my HRSDC file number. How can I send it to CIC-Vegreville? Is it possible to ask them to hold my application till I get my positive LMO?

I have to mention that my current work permit expired on Dec, 10th.

Thank you,

Thank you,

Call CIC and give them the file # that your employer gave you. They have access to Service Canada's system so as soon as the LMO is approved/rejected, CIC will make their own decision as well. Good luck! Smiley

Hi..

1. Unfortunately, CPC-Vegreville will deny your new WP application if no positive LMO is issued at the time you expect them to process your applcation based on the posted processing times...

2. Call 1-888-242-2100
No.  CPC-V won't delay the decision on your application.

Let's hope and pray that your positive LMO arrives soon prior to WP application decision, otherwise, you have to take the option of reapplying for WP with the LMO in hand and restoration of status... Good luck...

My employer applied for LMO on 22-Nov and its for 2 years....so do you guys think i can get it in February?

Are you receiving the wages stipulated on your contract?

They have yet to draw up the new contract.   I am still getting paid according to the old contract even though my new LMO related WP is effective from Dec 15.   I have sent out a few mails to my HR and payroll team and am waiting for them to respond.

Hi uncetainity,

I think the 12 weeks waiting period is from the date they officially receive the application and address the file number. Mine was received on the 30th of September and they started processing it on 19th of December. I am still waiting to hear something now because the Christmas period has added an extra 2 weeks to the waiting period.

If your employer is trying to commit fraud this is quite a serious situation. Once you know for sure this is what they are doing you have 2 different options:
You can report them and in that case you will loose your work permit and the employer will be permanently disqualified from the foreign worker program. The other option is to take the lower salary and work in Canada, but when you try to apply for permanent residence you will not be able to extend the work permit after 1 year. They want to see evidence of payslips and the actual wages you received during the year, before they will issue another LMO.

Have LMO processing times decreased? Work permits are only taking 34 days since last week. They used to take up to 72 days less than a month ago. Have processing times decreased for LMOs as well?
