LMO on PGWP....JesON plz shed some light!

I've been following the forum for a while and became a member and learned a lot of valuable info from the senior members. My question is specifically to Jes, many thanks in advance!
I am working as an Insurance Service Broker for 7+ months and will be applying for LMO soon. I'm not sure if my job qualifies under skill level B! NOC: 6231 Insurance Agents and Brokers- is the closest match for my position but the description talks about sales position and I'm in the service department, can I still apply under this NOC? Also, how does the LMO application works when I'm already working for the employer for 7+ months, in other words I'm not being hired as a new employee so what does my employer need to do to show that he could not find any local candidate for the position and would like to continue employing me?

I don't know specifically what your duties and responsibilities are.  Unfortunately, I suspect that this is your NOC:

Unfortunately, because it is not skilled and will not qualify for CEC.  You will have to be honest with yourself - are you a sales agent/broker, or a customer service agent?  If it's the latter, and you apply as 6231, there's a chance you could get lucky, but more likely you will just lose your application fee.

This depends - are you currently on a PGWP?

yes, I'm on pgwp which is expiring on July 22, 2012.

I work as a customer service agent but I'm a broker as I had to take the licence exam and I'm a registered insurance broker of ontario and alberta. but the job duties of NOC 1434 closely matches with what i really do! I'm so confused. Do you think if I can make my manager write a letter which will be similar to the noc 6231 might work? My CEC app is in process since June 2011 and seems like both my jobs are unskilled not sure where to go from here!

I doubt you can "make" your manager to do anything   I suggest that you have a discussion with your manager, tho, show both NOC descriptions and ask if they would be comfortable writing a letter that emphasizes the broker duties.    Since your application is already in process, I suppose you're asking in case you need to re-apply...

For the LMO, as posted in this forum many times, for an employer to obtain an LMO for someone originally hired under the PGWP, there is no need to demonstrate recruitment efforts; the reason must be explicitly stated (originally hired on a PGWP), and they have to check "yes" when asked if 'intent to permanent."   Supply a copy of the PGWP.

But be warned, the position must be a skilled position... (6231), so you can discuss LMO and the Letter at the same time...

Also, if you eventually get a positive LMO, Service Canada will make a determination on the NOC and you will know for certain which it should be.

On a different note, this might be helpful for those trying to determine if a position is skilled - the 2nd digit of a 4-digit NOC determines the skill level. For example:

NOC 4122 - 1 corresponds to skill level A

NOC 6231 - 2 corresponds to skill level B

NOC 0015 - 0 corresponds to skill level O
