LMO mandatory?

Hi all,

I am new to this forum and would appreciate any response to my dilemma below:

Is LMO a must in all cases? I am spouse to an international student with open work permit until Dec end and again extendable to another three years. I am working with a company for over 1 and half years. It is a good company but it may not take the trouble of filing an LMO for me. I have been recently offered a permanent full time job as a technical sales specialist and wonder if I LMO is required for me.

It depends on several factors

A) Skilled Worker: depends on your education and work background

1) if your are eligible under FSW (Federal Skilled Worker) then no LMO needed
Check for FSW  http://www.cic.gc.ca/english/immigrate/skilled/index.asp

2) if your husband is graduated from Canadian university and have one year full time work experience in skilled category, or you have two years full time work experience in skilled category (skilled categories mean the experience should fall in skill level 0, or A, or B, check following link for NOC code for your experience     http://www5.hrsdc.gc.ca/noc/english/noc/2006/html/Matrix.html)
Check for info on Canadian Experience Class (CEC)  http://www.cic.gc.ca/english/immigrate/cec/apply-who.asp

3) for provincial nominee LMO is a must in all cases expect the applicant has successfully completed a Masters or PhD degree from public funded Ontario university then he can apply for Ontario PNP without a job offer. There is a Cap 1000 nominees per annum for applicant with Master degrees, no cap on applicants with PhD. in all other cases LMO is must.

4) Quebec Skilled Worker : Skilled immigration is based on education and work experience (you can do evaluation at  http://www.immigration-quebec.gouv.qc.ca/en/index.html) and if you are a student or temp worker in Quebec the process is similar to 2.

B) Investor,  Entrepreneurs, Self Employed Class
Investor need a min net worth of $1.6 m  and min $800K investment in Canada, plus have business experience

Entrepreneurs: Min 2 years exp as entrepreneur,  min net worth of $300,000  (Check for more info: http://www.cic.gc.ca/english/immigrate/business/entrepreneurs/index.asp)

Self  Employed: relevant experience that will make a significant contribution to the cultural or athletic life of Canada or
experience in farm management and the intention and ability to purchase and manage a farm in Canada

Approx in all cases proficiency in English and proof of funds are required. To prove English proficiencey proficiency IELTS is needed. For Quebec French and English is required with more weighted for French proficiency.

I read all of those links you suggested, now the question is, if you may:

I am confused regarding whether "technical sales specialist" (retail) falls under category "B". Among the mentioned job responsibilities I meet 9 out of 12 that are listed but it still seems to me as related to either wholesale or manufacturing industry, whereas I work in retail industry. Do you know what is the best way to confirm whether the position is under B? Thanks in advance

sorry missed the portion. Here are the responsibilities taken from the NOC list that are similar:


•   Promote sales to clients
•   Conduct clients' needs assessment and finalize sale
•   Assess clients' needs and resources and recommend the appropriate goods or services
•   Provide input into product design where goods or services must be tailored to suit clients' needs
•   Illustrate benefits from use of good or service
•   Estimate costs of installing service
•   Prepare and administer sales contracts
•   Consult with clients after sale to resolve problems and to provide ongoing support
•   May train support staff
•   Technical sales specialists usually specialize in a particular line of goods or services.

Hi Tek, it solely my opinion other people may give better view on this.

In my opinion your occupation falls in NOC 6421 which is skill level C, so wouldn't be classified as skilled occupation.

Technical category falls under the NOC 6221, which is skilled level B, but flooring specialist doesn't fall in this category

so your experience doesn't meet the experience required to apply under Canadian Experience Class. Again its solely my opinion.

hence if you don't have work experience in one of the professions listed on MI then you need LMO to apply for PR under SW-1.
