Author Topic: Live-in Caregiver married to failed Refugee Claiment!!  (Read 675 times)

hi
Im a live-in caregiver in toronto. I just got married to a failed refugee claiment who is going back to pakistan in a week. I have finish my 2 years requirment for PR so ill be filing application for PR. My question are
1: should i just include him in my application or does he have to fill his own application? Can anyone tell which application form do we have to fill (eg: IMM Huh?)
2:About proving our marriage we have 2.5 years of call history and also around 200 pics which includes us and our friends in it. We also recieved a congratulation card from his parents. Are this enough proofs to show are relationship is genuien?
3:Ill be applying for PR in May can anyone tell me how long would this kind of process will take ?
4: He is leaving in a week should he do his police clearance for canada before he leave or when the immigration ask his to do it? i was  thinking to send it with my application.
last can anyone explain the whole procdure we would be going through please

One more thing
We checked Islamabad process time which is very long can he somehow request to process his part of application in bejing where process time is very less even if he live in Pakistan?

No, you cannot request to process his application in China (or else everyone will do that and China office will very soon have the longest processing time).  His will be processed in pakistan.

One more thing
We checked Islamabad process time which is very long can he somehow request to process his part of application in bejing where process time is very less even if he live in Pakistan?

Correct me if I am wrong but I think by filing PR application after 2 years of PR you mean applying for citizenship for yourself.

As for your spouse, I am assuming he is returning to Pakistan while you will stay in Canada and apply to sponsor him as your spouse. Here is the link for the application forms:

Your application will go to Mississauga which is currently at 38 day timeline. So in just over a month you will hear if you are approved as his sponsor. The application will then be sent to Islamabad where it will probably take around 21 months to process it. Thats the timeline for a straight forward case. His is a bit more complicated as he is a failed refugee claimant and must be facing a deportation order and he might need to get an "Authorization to Return to Canada" which might take a year to be processed.

You need to add him to your application as a family member.

http://www.cic.gc.ca/english/information/times/perm-other.asp these are the current processing times.

Normally, one does not need to provide police clearance for Canada. If they need it they request it. It doesn't hurt to add it though. In that case, he should try to apply for it before he leaves. You do not choose where his part of the application will be processed. CPC-Vegreville will get in touch with the appropriate visa office based on his country of residence.

She is applying for PR as a live in caregiver and her husband will be the accompanying family member. The Application is sent to Vegreville.

No, she is here on the Caregiver program. After 2 years they can apply for PR. She is applying for PR for herself now. She should add her husband to her application.
To the OP: whatever else you do, make sure to mention to CIC and on the forms that you are now married.

by 2 years i meant that i worked 2 years as a caregiver which is a requirment of live-in caregiver to apply for PR..
So how long exactly would it take him to come back?
what if he goes to beijing and start living there on a study or work visa can it then his file be transfered there?

Yes he needs to be listed as a family member. I haven't seen the forms so not sure if he needs to sign anything. Try browsing all the forms on CIC website before he leaves and see if there's anything he needs to sign. Good luck on your application.

The OP's husband, as a failed refugee claimant, will also have to apply for ARC.

how long does ARC take from islamabad?

keep in mind .it will take him to  go back to canada more than 4 years or may be more .... its very lengthy in Islamabad.
plz contact me asap before ur husband leaves  or u have a date for ur pr in mississauga .
i can explain few imp things to u in this case .
