Hi,

I had my employer visa expired and if I work, I was not supposed to be paid by check but my employer does not want to pay me cash.  So, he wrote check to my agency and my agency was supposed to pay me cash but every time they told me their probolem and delayed the payment for now 8 months.  What can I do?  My working visa is still valid for another year.

Why can you not accept payment by check?  If the problem is that you do not have a bank account, you can easily open one.

In order to get the money that you are owed, you can talk to the employment standards in your province and complain about unpaid wages.  They will help you.  You might however want to talk to your employer and agency before you do that as they may prefer to solve it without involving them.  Involving the employment standards may cause your agency and employer serious problems, the agency could lose their license to operate and your employer may never get another LMO to hire another LC.

If you do not want to stay with this employer, you can leave this employment at any time.  You would then have until the expiry of your permit to find another employer, get a new LMO and a new work permit.
