Hey friends,

Forgive me if this is an old question but I couldnt find the answer.

While I´m waiting for my PR process, do I have to leave Canada after 6 months? Im under a multiple entries tourist visa and although I know that, in theory, I can leave and come back with no problem, I´m a little upset.
I read a lot here that, during the process, its not good to leave Canada because if the guys from the customs dont let you enter, your process is automatically cancelled.

Can anybody help me?

THANKS!  Wink

You can just apply for an extension before your 6 months is up.   It costs $75 and you can do it online or through the mail.  Fill out the form and include all applicable info and send at least 30 days before ur current visa expires (or even 1 day before, the 30 day us just a suggestion not a rule).

The reason u include is that u would like to stay in Canada until the processing of your PR app is complete. Include a Copy of receipt of payment for PR as well.  Also a letter of support from your spouse, bank statements showing you/spouse have money to cover your stay, letter from spouses employer and I included a couple of my last pay stubs but I don't think it's required.

Is this an inland app or Outland?

Hi kelkel, thanks for your answer.

I´m going to apply inland.

Well, maybe I didn´t explain myself well. My passport and canadian visa (multiple entries) are valid untill may 2013. The point is, like all other countries, I understand I can´t stay inside Canada for more than 6 months. I´ve heard people saying they just went to Canada/US border an returned in the same day. Do I need the form mentioned by you or is it easier just to go to the borders?

Thanks!  Wink

Can I ask why you're choosing inland?  Timeline for Sao Paolo is max 10 months.  I would also send the form in vs going to the border.  Saves you the trip and saves you having to talk to immigration officers Sad Ew.

Immigration officers, I´m so scared of them! LOL

Well, I got some wrong information from the canadian office in Brazil, they told me I would have to remain in Brazil. Also, I´m so upset about sending a mail with all my documents to Brazil. To give you an idea, all the times I tried to send anything from Canada to Brazil, they got lost in the limbo...

Another point is that, by sending the "Change of Status" form with the PR application, I will get my work permit when the first stage is approved, right? My main concern now is that I can´t work here yet (even though I have 2 degrees, specialization courses, it´s so frustrating...).

Well, now you clarified my doubts, maybe I will apply outland!

Thank you very much kelKel!

If you applied outland, you wouldn't be sending your application to Brazil. It gets sent to Mississauga first to assess the sponsor, and then Mississauga forwards the entire thing using their own special diplomatic courier to the overseas visa office. True, if you somehow missed something and Brazil has to ask you to submit additional documents, you'd still have to courier them to Brazil. But that's just one of many reasons to do your best to make sure everything is complete beforehand.

Yes, you could apply for an open work permit (OWP) at the same time as applying for PR inland -- but you wouldn't be eligible for that OWP until you got first stage approval, which takes about 10 months right now. Whereas if you applied outland, you could be completely done by then. Not to mention that you can still leave Canada if something came up that needed you to without jeopardizing your PR application, and outland has right of appeal.

Hi Rinnerz, I still haven´t applied yet. I was going to apply inland but after reading some posts here I think I´m gonna apply outland. Since I am in Canada now, I would have to send everything Brazil by mail or check if any of my brazilian friends are going to Brazil in the next weeks.

Thanks!

If you are applying outland - you send the entire file to Mississauga. Once they finish with the file, they will forward it to Brazil.
