Helooooo Everybody,

Today i recieved post mail from CIO, NS.
In which they return my complete application with DD, Moreover covering Letter states that,

Regulation 12 of the Immigration and Refugee Protection Regulation states that if certain requirements are not meet, the application and all the documents submitted in support of the application shall be returned to the applicant. A review of your application indicates your submission fails to meet these requirements.

    1.  You have failed to submit the required processing fees or the fee you submitted is not acceptable form of payment. (See Appendix A)

   2.  The individual indicated on use of Representative form (IMM5476) which you submitted is not an authorised Representative.  (See Appendix B)

  3.  Your submission dosenot meet thge requirements of an acceptable applicant set out in Regulation of Immigration and Refugee Protection Regulation.  (See Appendix C)

Content of Appendix C in marked in Red is as follow:-

You did not submit a photocopy of following

1 Work permit
2 Letter from employer
3 Study permit
4 Confirmation letter of HRSDC/Service Canada,


What does this actual means, whether mine application is rejected or they wants me to resubmit application with a letter from employer.
Plz help me with your advice and clarification.

Hi Singhsaab,

As far as I could understand the reply to your queries is as under:-

1) In which form did you send your application fee i.e. US $ of CAN $ or Rs., if it was not CAN $ CHC can refuse.

2) If you have sent the Representative form the representative might not be a CISC Registered lawyer authorised to represent clients.

3) If you had applied with AEO you might have not sent the Employer's Letter.

This is my opinion.  Let senior reply to your queries.  BTW under which category did you apply?

In your case you fail to meet the requirements, they didn't complete the review of your application, so there is no question of rejection. You can resend your application after meeting the requirements.

As the guys mentioned above your application was not refused, it was returned to you unprocessed because of the missing documents as they have stated for you in their letter.

For your money order: go to the bank and ask them to make money order in canadian dollar by 550 made payable to (Reciever General For Canada).

It appears that your representative knows nothing about the immigration instructions (he couldn't even let you make the money order properly).

You said that you applied under category two, how come you haven't sent a copy of your work permit, letter from your employer !

Anyway,to help you i need answer for the following questions :

What is your current status in canada (foriegn worker or international student)?

How long have you been in canada under that status?

If you have a work permit, which kind of work permit do you have; post graduation work permit or student work permit or regular work permit confirmed by the HRSDC/Service Canada ?

Presently I am in India, working as mechanical engineer in Automobile Industry and have job offer from a canadian employer. I had made DD of 550 CAD, so there isn't any issue in that, moreover the content writen in red only is the non-conformative found during intial check at CIO. I had checked the consultant list in some websites, my representative was there in the list.

Even when i checked the returned package,i found that the letter of from employer is not being sent by me, which further results this.

So I am going to resend my application with employer letters.

Oh i thought that you are living in canada because of the requirments that you have mentioned above such as study permit, work permit....etc.

Be informed that you need an Arranged Employment Offer  confirmed by HRSDC/Service Canada in order to apply under category (2), a letter alone from your employer is not acceptable if the offer is not confirmed by HRSDC/Service Canada.



THis is exactly your situation :

"4.You do not intend to work in Canada before being issued a permanent resident visa, you do not hold a temporary work permit, and

a.the employer has made an offer to employ you on an indeterminate basis once the permanent resident visa is issued; and

b.your permanent job offer has received a positive labour market opinion from HRSDC. You cannot apply to HRSDC for a labour market opinion yourself. Your potential employer must apply for you.

c.you meet the Canadian licensing or regulatory requirements for the job."

Yeah I had a job offer from a canadian employer, which is further confirmed by HRSDC or you can even say Arranged employment.

I had applied FSW cat 2 i.e Skilled worker with arranged employment.

Why haven't you submitted the job offer letter along with the confirmation letter by the HRSDC in your first application ?

if you have them right now submit them with your application agian (it is mandatory not optional if you want to be eligible under category 2)

One thing more I want to confirm that, I am working as Mechanical engineer in Automobile Industry, so my experience is under NOC 2132. And I have job offer of Mechanical repairer under NOC 7321. Will anybody predicts the chances of PR Visa, As I had listened from Many that automobile sector is under critical conditions in Canada.

Hi,

I think you should send original IELTS score card, anyway please confirm from seniors.  As for automobile sector, as long as you have AEO confirmed by HRSDC there should not be any problem.
