Guys,
I love helping people, just as you all do, however I been unfruitfully posting in different threads including this one my situation to get guidance but unfortunately after a 10 days almost no luck. I know my case a bit complicated but your help can help me out, in order to reapply still in this month of June again with all of you. 
Pleasssssssssssseeeeeeeeeeeeeee....really would appreciate your help...I am rewritting my situation for your feedbacks.

Case:
-Old application Jan. 2008 with wrong NOC: 0114 Adminstrative Mgr.
(NOC not in the list of 38 NOCs eligible for the PR that changed in Feb. 2008, reason why old application refused.)

-New application want to correct NOC with 0111 - Financial Manager or Controllers (duties really fit my activities, 1st application only had 6mo. of experience with 0114 but now I have 3years of experience which is actually 0111 but need to fix the NOC from old application)

Answer from Office for old application:
" As your occupation(s) are not included on the list of eligible occupations, we are unable to process your application at this time.¨

I took that response from the Office as a refusal b/c of the changes in requirements in Feb. 2008.

For the new application in Schedule 1, there is a question that says:
¨Have you been refused status in, or an immigrant or permanent resident visa to Canada"
I will be answering YES, per other members suggestions.

However, there is a little square below in the application for explanation.
So, was wondering if somone would like to help me on what should I write in there since I dont want Officers thiinking I am changing this just to be elegible for the visa, cuz is not thhe case.

One last thing, should I sent detailed duties to the CIO Sydney a reference letter from my supervisor or HR, even though they don't ask for this in this stage, but due to the situation of changing NOC ?

Your application was not rejected but its was returned due to non-eligibility...so don't write yes in that schedule 1....
CIC don't have any records of applications returned...So go ahead as i 'm doing the same things...

Preetdhillon4u, during my search of feedback, I just got one answers from Profesionnal1 that went this way..copying his 2 quotes..reason why I was putting YES to refuse...let me know what you guys think, do you know anybody who had our same situation and what actually they did in their reapplication?

Yes, your old application was refused, even though it was their mistake not yours, but it is refused and your old file is closed and recored in their system as a refusal because of the in eligibility under the new rules. you will have the 550 $ refund for that.

When you re apply, answer yes in the application form for the question asking about the refusal, and it would be better if your attach an explanation letter about what you have just said, but it is not mandatory to do so.

When you re apply, do not write any anything conflicts with your information in the old application not to get refused under the misrepresentation grounds, they will already go back to your old application, and review every single detail written about it on your CAIPS notes.

regarding the 0111 work experince you have, if it was gaianed after you submitted your application to them, supported with documents, that would be good, if not, they are not going to be satisfied about it (keep that in mind).

Finally, as i told you, if you have the intention to apply now, do not correct anything that conflicts with your old application ( make both of your applications integrate with each others not conflict with each others in their information).

This is completely false information given to him by his lawyer, his application was refused and not returned as he thinks.

Your case was refused, and recorded in the CAIPS notes and there is a file number for you should appear in the refusal letter sent to you by the visa office.


If you would like to see what is written exactly in your CAIPS notes, order them before you apply again, and you will find all of the information and reasons of the refusal in your case on the immigration department system.

•   Served as Manager IT. Responsible for Implement IT Culture in xxxxx and design and develop IT infrastructure as well as Design and development of ERP system.
•   Responsible for initial architectural direction of all new “front door” projects and plan, organize and manage operation of IT department.
•   Responsible for investigating, recommending and implementing all new Network, Database, and software technologies within timeline.
•   Responsible for managing Software, Network and System administration team.
•   Responsible for developing and execution of IT and Security policies and procedures.
•   Responsible for developing and execution of IT department financial plan and expenditures.
•   Responsible for recruitment of IT personal and professional development and training.

Please guide if need to change/ modify any thing.
