Author Topic: Is there an appeal if you receive a negative response under FSW?  (Read 364 times)

My CC was charged on 8/3/11 and I have not yet received any response.

I did not include a copy of my Registered Nurse License in with the application. The instructions did not specifically request licenses. However, the letter from my employer states I worked as a Registered Nurse and my Diploma shows I graduated from a Nursing School. In addition, I passed the Canadian Nurses exam and included the letter of passing.

If you are denied due to one or two documents missing, do they give you the chance to provide the documents or do you have to refile next July 1?

Any help would be appreciated. Thanks.

Nope, if the application is considered incomplete and returned, you have to file a new application.  If the Cap is full, you are out of luck until the next year, if the occupation is still in the list.

Then, your app goes to the VISA office for further review?

Your card only gets charged when all docs are in place...ie passed completeness check. After that, it is reviewed after which you get positive or negative eligibility review via e-mail. If it's positive, ur file will be forwarded to VO for further processing. If negative, they return ur file with a refund. Once returned you can only reapply if ur NOC has not been capped. You can only challenge CIO if you believe you wrongly received NER. There is nothing like an appeal...Mandie

Thanks for responding but I am still confused....at this point someone has determined that I have submitted all the documents needed for the next step however..what is the next step? What is undertaken at the second step at CIO? Is there a chance that they could still give negative review if they think documents are missing or is that not possible since it passed the first level? What is typical for a negative review to ocurr?

did you email CIC and ask for status update? You should receive PER in two months max. (as per current timelines), did u check your junk email? have you given the correct email id  or postal id?..... because if it was negative,God forbid,  you would have also got an NER by this time... or call CIC and find out tomorrow..

What do you mean somebody? Have you received an e-mail from CIO? Your post is not clear. When did you apply? Mandie

Right, once payment has been processed, it means u passed the completeness check, u dont need to send additional docs at this stage.  Now the next step is that they will review your file according to the factors for for eligibility: age, edu, experience, adaptability, language. If you meet the 67 points you will get the PER via e-mail. Hope you understand the process now....Mandie
