Hello! Thank u for ur response. Yes i understand that i can work  continuously given that ill be working under the same employer. That is what i am doing now.
The issue is because my regular work permit has expired my alberta healthcard has also expired. They will just renew it if i have a regular work permit.
Another thing is i did not get our 1st stage approval in vegreville instead they transferred it to edmonton and they say it would take 18 to 24 months before a decision will be made. So should i wait for 2 years then? I am not hoping to get sick right? But i should have alb card just incase. Dont know what to do.                                                                             .

HI charmainefrances, regarding your Alberta healthcard, I know you can extend it for 3 more months, just tell them you are working on the extension. Thats what I did and they extended it. Hope that helps.

hello po! actually, I used that 3 month extension already... my regular work permit has expired June 2011, so yes, I asked for extension for alb. healthcard and it ended Sept. 2011..and they won't extend it again unless I have a regular work permit and now, they are saying that it would take 18-24 months now before a descision will be made, so meaning to say, I will wait for 18-24 months without a alb. healthcard.Huh?? as I have said, I am not hoping to get sick but the question here is WHAT IF? wahhhhhhhhh!!!! Hello everyone!

We need help! We submit our application under In Canada class spousal sponsorship last September 26 after gathering/completing all the requirements. We check on Canada Post website if our application was received and it was on September 28! BUT for some reason when we checked if CIC received the application thru automated phone service it says nothing!!! We aren't able to check it on ECAS as well. And the customer service agent says we should call after 2-3 months. We are so worried that the application is lost somewhere. Please advise us what to do. Thank you so much!

No worries, It is there, it takes as the agent said 2-3 months in order to be able to see it on e-cas or agent being able to see anything...they received our application on Dec 24th 2010 and we were able to log into ecas on Feb 14th, which it the date they stated to process the application.

So sit back and relax, it is a long wait.....:-) It works your patience believe me !

Forget a new work permit, read this:
If CIC received the application for the Open Work Permit BEFORE your current work permit expired, then you are under 'implied status'. This means that: until CIC made a decision about your OWP demand, you can legally continue to work under the conditions of your last work permit, that has now expired. So: the expired work permit is still valid and with that, your SIN is still valid, even though expired. How this works out for the health insurance: I don't know. I suppose it's still valid too, because you still have the legal right to continue to work. If your last work permit was an open work permit, you'll still be able to switch employer during implied status. The only condition is: don't leave and re-enter Canada while on implied status: re-entry will cause implied status to void.

Your lawyer was right, for the OWP you HAVE TO apply by mail. Not to the work permit department, but to the PR department. It can take up to 2 months for the envelope to leave the mailroom and be opened. That's why you should've written "PLEASE ADD TO FILE ASAP", so it could've been sent to the PR department within a week. Now it's probably too late...
The PR card can take up to 10 weeks to make. After landing, the local office needs to send the application to the office that handles PR cards, so it can take a few days in the mail. Than, in the worst case, it takes 10 weeks (almost 2,5 months) and then there'll be a small delay in mailing it to you. Call CIC in another 2 weeks or so if you haven't received it.

@  LY: congrats on the good news for your new job. Happy starting! Smiley

Our case is now complicated since they transferred our file to a local CIC without an AIP. When I phoned CIC, they say it would take 18-24 months before a decision will be made....
Yup, I know that I can work under the same employer and SIN is still valid even if it's expired. but the healthcard, they want a regular work permit in order to renew it!

So now, I have to apply for a regular work permit under my employer, so I can renew my ALB. healthcard! I should have done this before beacuse I really don't need that OWP. I'm happy with my work and I don't need to work somewhere else. but the CIC call center agent told me to send an OWP which sounded like it's very easy to have, maybe for some cases but not mine.

As far as I know, you can't get an OWP that way. Maybe you should check two more times, since CIC reps often give wrong information. Tell them as much details as possible, to make sure they don't make mistakes.

Thank you so much for the reply, much appreciated and that makes us feel lot better.  Goodluck to all of us and may all we have a fantastic Christmas and a happy ending of this long process of immigrating. We will be a regular visitor of this blog site from now on. We felt at home reading the thread and knowing that we are not alone.. Smiley At the moment, all we can do is patiently waiting for CIC's response. **sigh**

We don't have any idea about applying, we also can't afford to pay an immigration consultant at this point so we rely on CIC's website and blogsite like this to informed us better. So thank you!!

Cheers!

Dear Charmainefrances,

While you solve the issue with your AHCIP coverage, common sense dictates that you should consider purchasing private health insurance. The last thing you want is to be in need of medical care, whether it is an emergency or not, while lacking insurance.  An event like that could easily be devastating both financially and emotionally to anyone.  Don't take the risk!

Cheers
