I have asked this question before and have had various opinions.

I am asked what is your marital status,   I answer common law.

Then I am asked do I have a conjugal partner?

A conjugal partnership can best be described as a "marriage-like" relationship in which neither actual marriage nor cohabitation is possible due to circumstances completely beyond the couple's means to control.  Such circumstances include, but are not limited to, being unable to marry or co-habit due to cultural or ethnic barriers, neither partner being able to obtain a visa to the other's country.  Residing in separate countries, not wanting to give up employment or studies, lack of financial resources, not wanting to have an official marriage, or one partner having been refused a visa, are not sufficient to meet this definition. 

My partner is married in the Philippines where there is no divorce, however we have been living together for over 12 months continuously.  So we q

You are Common-law.

Conjugal is if you can't manage common-law or marriage.

I understand my marital status is COMMON LAW

The next question is  DO YOU HAVE A CONJUGAL PARTNER??

If I am living common law with my spouse is she not a conjugal partner.  If you look up the definition of conjugal,  she is my conjugal partner??

Do I answer yes or no.

I understand that common-law by definition includes the definition of conjugal partner...same as married as well. 

BUT...For CIC purposes you have either a wife, a common law partner OR a conjugal partner.  The form is written for the three different types of spouse sponsorship so some items have to be squeezed in and don't make sense depending on which type you are.  If you qualify as married you answer those questions...if you qualify as common-law answer those...and conjugal answer the rest.

Thanks so much for your reply, I have posted this question before and all of the answers were confusing.  It's funny how you can look at a question with blinkers on and just cant see outside the box.
