Hi,
I need to sponsor my partner under the common-law or conjugal partner class. It is a slightly complicated case. Can someone suggest a very good law firm who can help me with the end to end process. I can't afford a rejection.

I've been working with Michael Battista at Jordan Battista ( http://www.jordanbattista.com/) and I know that I have a complex case (we're now in judicial review now. I'll know in a couple of months if it was successful.) I've also heard good things about Mario D. Bellissimo at Bellissimo Law Group ( http://www.bellissimolawgroup.com/) from someone else who had a complex case. I've never had any dealings with Levine Associates, nor have I heard anyone say good or bad about them. Depending upon the type of complexity in your case, you might want to search through judicial review decisions to find someone that has been successful in presenting cases that might be in the same general area of complexity as yours (that's how I picked Jordan Battista, but honestly Bellissimo would have been comparable in terms of having won important decisions.) |

great tips guys. can you please tell me what would be the approximate fee these good lawyers would charge? I consulted one and she asked me 10k. I was surprised for that amount. Isn't that high? I can't afford...

The first attorney I used (here in Vancouver) charged $4,000 for a basic filing (it was in the Federal Skilled Worker category, though, not family, and it wasn't supposed to be complicated.) At that price I basically did all the work and gave him the completed application to review and then submit.
When I found my case wasn't going to be simple and my attorney wasn't really up to the job (he admitted as much) I switched. The new attorney charged me an additional $3,000 (his normal fee for the full application was $7,000.) Now that I've moved on to the next stage (judicial review) it's another $3,200 for the application - and at the judicial review stage you pretty much have to have an attorney if you hope to have any chance. If the judicial review is successful (20% shot) then there will be an added $1,000 on top.
You said "complicated" which means you'll likely need some assistance. To minimize the cost, have the application prepared BEFORE you go talk to attorneys. That way they can better gauge how much work is going to be involved. Also, if you can suggest what makes your case complicated folks on here might be able to make better suggestions for you to consider.

What was the reason for their refusal of your FSW app? It looks as if the first lawyer didn't do a good job for your case to be approved. |

hi rathika 2011, i am leel from italy. but i am srilankan and also i have italian citizen too. i can visit canada without visa for 6 months. but i want to know can i find a job and settle dowen in canada when i come ther as a visitor?? i can get help form your lawyer for settle down in canada?? thanks lot if you can give me a help or good advice. thanks again

As a visitor you are not eligible to work legally (that requires a work permit.) An attorney can assist you in filing the paperwork for permanent residence - assuming that you qualify - but you will be better served to do your homework in advance. If your spouse/partner is Canadian, you can file for sponsored immigration. If not, you will have to qualify in one of the other categories (like skilled worker.)

My case is as follows: I sponsored my spouse 4 years ago. She left me 3 years back and the divorce is happening in the court for 2 years now. It is taking too much time and I do not see an immediate end. Meanwhile, I have been in a relationship with my new partner for more than a year. We cohabited in Singapore for more than a year as it was easy for me to enter her country rather the other way. Now, I am being sent by my Singapore employer to Canada for 1 year contract. I am currently in Toronto. Since I am employed by a company outside Canada and given the fact that I am yet to be divorced from my ex - will I stand a good chance in getting my new partner immigrate to Canada? If yes, which class would be advisable - common law or conjugal? My new partner is pregnant - 1 month old...
