So I made the extremely difficult decision to make contact with my oldest children's bio-dad (no contact for 13 years) to try to get permission to take them to Canada with me. I made this decision because even though I have sole physical and legal custody, he has visitation and everything I've read says CIC will put a stop to the application, even though I have court documents that CIC MIGHT accept (long story...).

So anyway, I found some countries require the use of IMM 5604
the only place I could find a copy of it was here: http://www.canadainternational.gc.ca/iran/assets/pdfs/visas/30_1_eng.pdf

Do I need to use this form, or does he just write something up that says the same thing and have it notarized?

You can use this form or a notarized letter saying the same thing.

Wow, never saw that form before, but it works, and it's probably easier to present him with something like that to sign and get notarized than to ask him to write something himself, or to sign something you wrote (if your separation was as acrimonious as mine was!). Anyway, that's a very simple form, and covers all the bases.  Wish I'd seen that when we were filling out paperwork!

Married 9'06, ap sent 3'07 & refused in 1'08 due to inadmissible son.  Won appeal 1'10.  Back in process 4'10, new meds req 5'10 - submitted in June.  New FBI submitted 8'10  Approved 30Nov2010! COPR recd 05Jan2011. LANDED 31Jan2011 YAY!

Thanks guys! I'm gearing up for a major fight on this (he was abusive, I'm hoping he's grown up, but we've literally heard nothing from him in 13 years so I doubt it since he has no interest in his kids...but he won't have a problem refusing just to mess with me), and preparing the paperwork to go to his state (where the divorce took place) to get the custody modified to remove the visitation. Not fun!! Hopefully this will end up being quick and painless!
