Dear Friends,

I have been writing in this forum and got some very useful pieces of advice. I really need some good ones for this

My (x) husband and I divorced 2 years ago. After our divorce my husband applied for Canadian immigration and did beg for my help becuase his points alone were not enough. I asked him to withdraw my name immidiately but by different threats he forced me to keep quite and not to reveal our divorce to CIC. Now I am stuck with him and can not move on. I want to withdraw my name and want to inform CIC about all the above.
My question is

If I inform CIC and send them my divorce document, will they inform him that I reported this case? (I don't want this because this wil make my son and my life very difficult) but at the same time I want to save myself from fraud.
Is there any way that I can call to someone in CIC to explain my position? (has anyone done this before)

Hi,Diy, I am so sorry to hear that.
If you want to withdraw him, and sent divorce document to CIC,yes, he will know that.
One way get to know is CIC website status will show "withdraw" in stead of "IN PROCESS"
and another way get to know is CIC will sent a letter to him to mention that.
I think the best way is to make an appointment with a lawyer, and  discuss how you could do.

My ex husband is still after me to cooperate in getting his imigration done. He applied as principal applicant for imigration soon after the divorce but has kept the divorce secret from CIC. I kept asking him to withdraw my name but he did not listen. Now he is again threatning me to help him in getting his documents completed but i want to get rid of this. I want to inform CIC,and in this regard want to clarify a few things:

1. Will my ex husband come to know that i revealed the fact to CIC?

2. As it already been 2 years of divorce(unreported to CIC), will it effect my credibility in CIC if i inform now(in case i want to apply independently in future)?

You need to report it. One way or another Canada Immigration will find out, and your ex will find out that CIC found  out!

You need to find a way to communicate it to CIC otherwise you will be liable for misrepresentation and can be found to be an accomplice to fraud. Get help from a lawyer or immigration consultant if unsure how to proceed. Get other  people on this forum to give some advice, but from my point of view, you definitely have to tell CIC of the situation, make it clear that you've been threatened to be silent on the issue.

Diy, I am assuming you are applying together for points, correct? Hopefully your ex has not already landed as a PR yet, if not there is still time to withdraw the application. You DO NOT need his permission to withdraw. You can be strong and get through this. I would also talk to some groups that can help you deal with such abuse from their spouse how to get through it. You shouldn't have to go through this. If you feel unsafe, contact the police and then contact CIC. I know you may feel vulnerable right now and scared to do this but you need to do what is best for you. You deserve better. So do the right thing, contact CIC about his misrepresentation, tell them he was forcing you to do so, and withdraw the application. You don't have to go through this any longer.

P.S. No your ex does not have to find out. If you are in danger, talk to CBSA, CIC, and cops in your area if necessary to make sure you are protected. And if you are afraid of your creditability with CIC for your own application then just write to them explaining the whole situation and how you wanted to do it the proper way without someone forcing you to be a part of their application. They will appreciate the honesty more than hiding things. Agreeing to follow through with this misrepresentation isn't going to make it easier on you.

Well thanks everyone.
I know i must report this issue to the CIC. But I need a really good lawyer to help me out in this. Now I understand that a lawyer who is in Canada and knows Canadaina Laws will be most suitable one for me to hire his services. Does anyone know any good person who can help me out in this

its a very simple case,
scenario 1, have u guys formally registered divorce with the province of ur residence?
Scenario 2, opposite to scenario 1

in case of scenario 1, u're pretty much cant do anything cuz THEY WILL find out on their own, i suggest before they find out tell them urself in order to protect ur id from getting black-listed and possible legal ramifications.

If scaenario 2 applies then its totally ur call!

Something you can do is contact the Visa Office by phone, and ask to talk to an Immigration Officer (IO).  Without providing any documentation, you can explain to this IO that you do not wish to sponsor your (ex) husband anymore, because he is threatening you and [etc].  The IO, in an informal manner, will put a note in the file of your ex-husband, that all other IO will see when they will come to the processing of his file.

Since the grant of an PR visa is subject to the subjective decision of IO, no Io will grant a PR visa to a man that has a notice like that in his file.  Your ex-husband will see his request denied.  He will receive a letter saying something like "Sorry, you won't have a PRV from us" on basis like "We don't believe your claims are true and that your marriage is genuine".  He will never know you contacted the Visa Office, and it will look to him like the Visa Office are cruel and emotionless, evil persons.

If he tries to reapply, the note will still be in his file and he will most likely never be able to get a visa of any kind to Canada, unless he uses a fake identity.

You have to remember that IO's job in Family Class Sponsorship is to protect you, the sponsor, from any bad-intended applicant.  The IO are humans and will clearly understand your situation, since it is their job and they see things like that everyday.  So, get a hold on the Visa Office where your ex is applying, call them, ask for the Immigration/Visa department and explain your problem.

Like I explained, just get the Visa Office phone number (browse [see link bellow] to find your Visa Office, click on it and the following page will give you the details of the office, with their phone number) and call them.

A member of my family was in a similar situation than you (no threats, just that she didn't wanted to support the sponsorship anymore), and did like I told you.  The IO wrote a note to the guy's file.  He was denied his request few months later, and never knew it was because of this.

The OP`s husband applied under economic stream and uses her to complete his points. It is not a sponsorship application. Although what you just suggested is a great option.
