Author Topic: I have 10 years US visa granted stamped on my passport but overstayed  (Read 756 times)

Hi, can somebody help me with this?  What do you mean by one year lawfully admitted in USA?  Is it the number of years you have for VISA stamped on the passport or the months or years you entered and stayed without overstaying status in the US? 

Can I apply as principal applicant?

It means that when you arrived at the US port of entry, Immigration gave you admission for 1 year.

nei deekra (no dear).  You will be able to apply from the States.  As long as you were given a visa of one year or more even if you are out of status, it will be ok.

Don't believe he was admitted for a year, therefor cannot apply to Buffalo.

Mavic, upon entering US legally you will be given a length of stay that is stamped on your I-94/documents. INS will give from 1 month to 6 months or MAYBE a year. This is the validity that Canadian immigration is asking. Sometimes, the 6-month stay will further if you apply for H1B.
