Hello,

Currently I am on L2 and staying in US from last 4 and 1/2 years. Recently our I94 expired (on july 31/2007) and got extension till may 2008. so now we have less then one year on I 94. Can we apply for Canada Immigration?

   Our second option is:
My Husband also has approved H1B, which will be in effect only if we go back to india and get it stamped. H1B will be valid for 15 months (H1B years - L1 years = 15 months). So should we wait and apply for canada immigration after we come on H1B or we can go ahead and apply now with 6 months on i 94??

Thanks.

You may apply now. If you have been legally admitted(Which you have been since you have L1 and H-1) for a period of at least  year then you are good to go.
