Author Topic: Husband has Canadian PR but wife and kid (born in India) don't have a PR  (Read 320 times)

I am working in US on H1B visa and have a Canadian PR since Oct. 2008. Stayed in Canada for couple of days for landing. I want to move to Canada by this august 2011 ending but the problem I have is my wife and kid both don't have a PR and I would like them to accompany me to Canada.
Can I apply them a Canadian visitor's visa and take them to Canada with me so that while they stay on visitor's visa for 6 months I can apply for their PR card.

Please do guide or provide your valuable suggestions.

You can apply for a visitor's visa for them. Usually such applications are refused, but there is no harm in trying. With the application you will have to provide proof that they will leave Canada at the end of their visit. Are they with you in the USA now?

Best option is to apply outland in India for PR, since you have a child you will be given priority and can get it within 3-6 months.
But the issue is as a PR you have to reside in Canada to sponsor, so you would have first move to Canada and then apply.

Applying for tourist visa is tricky ...you can try and may/maynot get it....
Even if you try applying Inland on a tourist visa chances are it will be transfered to ND..these days there has been file transfers to home country and i see it a lot.

My advice, don delay your sponsorship and cause a red flag when you apply.
And where does your wife/kid stay currently? if it is US, gettin a canadian TRV is easy but if they live in India it makes it more difficult.

Thanks for your valuable suggestions. I married her in Oct. 2008 after getting my PR card. I have my H1B stamping also so I am thinking to apply my wife and kid's H4 stamping that way I can apply for visitor visa.

Please guide.
