Hello guys
I had sponsored my husband in 2009 from Sri Lanka. His visa was refused, but now i won the adr hearing. do you gusy have any experience in appeal. Please let me know about . Please guys

Well it can't be too long. After my appeal, the mail was on strike so that it slowed it down by a few months. It should all go back to your husbands VO, where he'll be given instruction on what to do next.

I won the appeal hearing June 23rd. They received the files August 5th. They started processing the files September 5th and now we're just waiting. I'm so frustrated and I don't even know what to do. Everything is finished. His medical his police clearance. What more can we do?

They didn't believe we had a genuine marriage. My husband was really nervous and he forgot a bunch of important stuff. We also didn't include enough proof of communication, like e-mails and letters, or even enough wedding photos. After he failed the interview, I went to live in Turkey for almost 7 months until I was given an appeal hearing date, after which I flew back to Canada for it, in Vancouver.

i see.. why he was not ready for that interview and if you married why you guys never took wedding album ? nothing to prove how come also nothing to prove you side family members that any communications didnt you had a consultant ? i wish you good luck

Well we didn't think it was necessary to include all our photos. We filled out the application, and that was pretty difficult because my husband doesn't speak English, I've learned Turkish. Last summer my Mom traveled with me on my way to Turkey and stayed with us for 5 weeks. That was the first time she got to meet my husband in person. She also met his whole family. No, I never had a consultant. I didn't know anything about that, and also considered a lawyer kind of costly for us. I thought we could do it ourselves, but I guess in hindsight... Anyways, we appealed it, and the judge overturned their decision, and that our marriage is genuine. So it went on to finish processing. Good luck to you, too.

i see .... first place when we send application approvel they send us back many times thats why i have took a consultant ALSO I dont know about this process but i study case thourh internet there web site how it goes and also you can pick the interview your own language . you should find a better lawyer a immigration approved consultent they only knows how this stuff goes. gd luck keep you updated

Yes he did have his interview conducted in Turkish. We specified that he needed a translator for his interview. I don't understand why they were testing his english, but they did do that,too. We never told them he was fluent in english, this totally threw him for a loop. After that he couldn't get back on track with the interviewer. It's been over a year since he had his interview, but it was pretty traumatizing for my husband. She wasn't very nice to him. He still has nightmares about it.

They 'test' the applicant's English when they are suspicious that the relationship is fake. If the applicant and sponsor do not share a language, then that is pretty good proof the relationship is not real.

How is that pretty good proof? We were always honest to Canada Immigration, that my husband wasn't gonna learn English until he came to Canada. I learned Turkish, I'm just better at languages than he is. You know, you need to be a little more sensitive about how you word things out there canadianwoman. How do you even know what is going on in the interviewers head? Obviously the interviewer disregarded what we had stated in my husbands application. Anyways we've been married for almost two years and talking for over 3. I lived there in Istanbul with my husband for almost 7 months. And in March I had to go before a judge, with no lawyer, and be scrutinized by an immigration lawyer, and then had the judge decide we really did have a genuine marriage. That we really did communicate well, and know each other. Maybe it might have been easier to randomly find a man from Turkey who spoke english, that I could fall in love with. Because that would make it understandable for ignorant Immigration Officers to believe that a relationship isn't fake?  Give me a break!!!!!

I was not specifically referring to your situation in my post. I know you know Turkish. Believe me, if the visa officer thinks that the applicant and sponsor cannot communicate because they do not both speak the same language, the PR visa will be denied. So they will 'test' the applicant to see if he/she can communicate in English or French, if those are the only languages the sponsor knows. If the sponsor knows the language of the applicant, or the two share some other language, then as long as the visa officer knows that they should not question the relationship for that reason.
