Is there anyone who can tell me that how shud I apeal against our refusal? is there any particular way to go and any duration time?

Hi! Belize,
If you apply outside of Canada you have 60 days to file for Judicial review, there's no appeal. The first stage is the leave stage, once successful on this, next is the judicial review process. You need a lawyer in Canada if you want to go through this process. I am already awaiting the decision of leave stage. Approximate time of waiting is 9 to 12 months.
My advise to you is consult a Canadian lawyer, waist no time and I think you have a strong case. Goodluck.

Belize, If you think you have a strong case and refusal was on wrong grounds.... send a represenation to CHC detailing your reasons and keep following up with them every 3 weeks or so... I did the same and from refusal, my case was taken up again and recently I received my visa...

Thank for yoru advise pls tell me what was the reason they mention on your rejection letter? and you think if they made mistake they open your file again? because from my side they just count my one code 4131 and experience and did;nt count any other expereince with different code they suppose to count all code and expereince becasue once your one count match they should count all experience. what is the meaning of representation? and do we have to send to letter or appeal to embassy right? We already sent to letter you think they will reply us  thanks.

Dear Belize,
There is no appeal process in FSW programme. What you can do is write a letter to the CHC to reconsider your application, indicating that the assessment is wrong. You said , U r not given the points for some of your work experience. Can you prove this work experience based on the documents already sent to CHC? If you are not sure I better suggest you to reapply and collect all the documents for your work experience(salary slips, IT return, bank statement).
My case was rejected due to mistake by VO in calculating my IELTS point. My case is strong because my IELTS score card is already with them, but still I am waiting for almost 42 days (after writing a letter for reconsideration), until now no response from CHC (Port of Spain). I wrote them 3-4 times as a reminder, but nothing comes out.

Hi Belize, the refusal i got was similar too, the IO considered my latest occupation without considering my earlier experience in NOC6131 & 6132 on the basis of which I had applied. I sent (actually my consultant did) letters to CHC Delhi explaining the error and they reopened my file and processed it again. In the meantime I did file a new case as well just in case the earlier application wasn't reopened... I am withdrawing that application now anyways...

are they consider new documents to support work experience. I had reference letter which dont have job duties on it,so i write explanation letter with it. but immigration officer misunderstood my explanation and reject my file. I got my job duties on company's letter head.will they consider this?
