Author Topic: How Can My Wife In Philippines Be Aided by Immigration lawyer here in canada  (Read 919 times)

My new wife in Philippines ,whom I married in Jan 09 and ,is having problems, with incompetancy, and delays in getting her Philippine passport(which i understand she needs before she can have a medical done)

She has never had passport.

Does she really need a passport from her country or can she appy for Canadian passport  since she is now married to me a Canadian Citizen ,here in Canada, to bypass the delays?

Can,a immigration lawyer here in Canada help her and I unite?

Also ,any idea of approximate costs to do that??

I'm no expert, but I can't imagine the answer would be anything but "No".  Surely only Canadian citizens can get a Canadian passport.  And if you're not a citizen by birth you first have to become a PR and after a certain period as a PR (I think 3 years within a 4 year period) you can apply for citizenship.  Once that happens and she's a citizen I assume she can get a Canadian passport.

If only it were as simple as you described! Then a lot of us wouldn't be on this site as we'd get citizenship after marrying our spouses and wouldn't have to go through the whole sponsorship/PR process.

I'm not sure how much research you've done into the whole spousal sponsorship process, but if you haven't already, read carefully everything on the CIC website about sponsoring your spouse (http://www.cic.gc.ca/english/immigrate/sponsor/spouse.asp) and start working on your application.  An immigration lawer can help you with the application, but opinions are varied as to whether it's worth using one or not.  I guess it depends on the quality of the lawyer you hire, and no doubt their costs will vary too.

She can not get a Canadian passport since she is not a Canadian citizen.  I don't know why it is taking her a long time getting a passport in the Philippines.  Maybe you should hire a lawyer in the Philippines to help her with that.

She first has to get Philippines Passport. You need to sponsor her. As we all know, the process from sponsor to visa approved could take 6 months or longer.

There is no way she could get a Canadian passport now.

Being married to a Canadian citizen does not make someone a Canadian citizen.  It does not even authorize that person to automatically live and work in Canada.  Being married to a Canadian citizen only qualifies someone to be sponsored for permanent residence in Canada - and then after she is resident in Canada for at least 3 years she can apply for citizenship.

A Canadian immigration lawyer cannot help her get her Philippine passport - maybe some sort of lawyer or official in the Philipppines could help with that, but Canadian officials have no clout there.  If you are married to her the two of you should be working on her sponsorship application because she won't be coming to Canada at all without that.  Maybe you already are, since you mentioned the medical exam - so then you'd know she needs her passport not only for the medical, but to get her PR visa.  No short cuts here I'm afraid.  Good Luck.

Married 9'06, ap sent 3'07 & refused in 1'08 due to inadmissible son.  Appeal won 1'10.  Ap back in process 4'10, new meds requested 5'10 - submitted in June.  FBI rec'd 8'10 after 12 wks!  Approved 30Nov2010! COPR recd 05Jan2011. LANDED 31Jan2011 YAY!

I am also sponsoring my wife but we are both currently living in the Philippines.

Many travel agents in the Philippines assist with getting a passport for filipinos.

If she can call a few and find one that performs this service they will do it for her and the fee is somewhere between 1200 and 1800 pesos.

She will need to go to NBI (national bureau of Investigation) and get clearance. This takes about a week once she applies.

She will also need to submit to the travel agent a copy of her original birth certificate.

She does not need a lawyer to perform this task, they will simply assist her in emptying her wallet.

Hope this helps,  we have been throught the process and its quite simple.

I just got my kids their passport 2 days ago


     PASSPORT REQUIREMENTS FOR FIRST-TIME APPLICANTS:
    * Personal Appearance is required.
    * Duly accomplished application form.
    * Birth Certificate issued by the National Statistics Office (NSO) Original
    * Three (3) colored photos of the applicant taken against a royal blue background.
       Applicant should be in decent attire with collar.
    * Proof of identity / Supporting documents indicating full name, date and place of birth and citizenship
    * Other Supporting documents.

     NSO Birth Certificate can be obtained in 2-hours with fee of P 140.00
     while passport cost P 500

Passport application is really not complicated. A step by step procedures is posted in the walls. There are not fixers once inside the dfa premises, its okay to ask around. Travel Agents charge i heard P 1,800 for all the work.
