Hi,

My attorney mailed me today stating that CIO have returned my file because I and my spouse have not provided Birth Certificate. The attorney further states that they had success in past with submitting secondary school leaving certificates as an alternative to a birth certificate in the past, and they believe that this return may have been an overight at the CIO.

We have already submitted the secondary school leaving certificates having our respective date of birth. In addition, had submitted birth certificates issued by Indian High Commission in Toronto.

As of now, we both don't have Birth Certificate copies with us as in India the secondary school leaving certificates are also considered valid documents as an alternative to Birth Certificates.

Am currently located in Toronto and would be difficult for me to get the certificates from back home. The attorney further states that they can resubmit the documents, but there are high chances that it may not be accepted by CIO.

Kindly advise, on chances of my application getting accepted by CIO on resubmission.

This issue is time and time again brought forward. With sketchy and confusing details.
 SO I guess, MAY BE in the past they were accepting other documents as a proof of Birth etc, but, now they are not. I re'd somewhere else as well of the rejection on basis of BC.
I guess you folks done have any other choice but to get a Birth Certificate from you home country.
Dont risk getting your application returned twice, will waste time and CAP is short.

Can we sumit our School Leaving Certificates, which we had not submitted earlier with application. We had submitted the 10th grade certificate mentioning DOB along with Birth Certificate issued by Indian Embassy.

Are you sure that your application was returned because the birth certificates were not included? Has CIO specifically stated that when they returned your application?

I got PER yesterday...and i had not included the birth certificates or the school leaving certificates.

So i guess the Secondary school certificates and the passports were accepted instead of the birth certificate.

I think you've not provided explanation letter to cio that you have this problem, please clarify Does in Cio letter they said we did not consider your request for Birth certificates, i think your lawer or consultant did not mention this issue in your application.

 @ Drooza - I received mail from my attorney (CanadaVisa) - David Cohen & team, CIO have returned the files, stating that Birth Certificates for self and spouse have not been provided. Have asked them to send me copy of the letter.

So I don't think at this moment CIO has returned the file stating they did not consider request for Birth Certificates. Can the covering letter from attorney mentioning the reason work with CIO.

i dont have a birth certificate...so what i did was i mentioned in the covering letter i attached with the full app that i dont have BC due to XYZ reasons and instead i am submitting my secondary school certificate, National ID card and passport copies as a proof of my date of birth and place of birth....they have ccapeted since i recieved AOR letter from london which is issued once they find your document submission to be complete...

Virajrao,

I did not get the PR yet...got the PER - Positive Eligibility Review from CIO, Sydney, NS...and as i told you i had not enclosed my birth certificates or the school leaving certificates.

I think if you cant get the BCs..you can write a letter like the above poster has suggested...i think it should work..i have also  read some posts on trackitt..where the absence of the BCs did not pose a problem and the file was processed. Good Luck !

 @ Yosemite - Have you applied under FSW category and had you provided covering letter for absence of Birth Certificates along with you application.

I do nt know what the procedure of CIO NS is now believe me every person is facing different problems.......there is no standard now maintain.........some got PER without BC..........some got NER without BC............some got PER without submission of Transcript...........some got NER without submission of Transcript............

Now im really consfused at forum.........some got through IELTS band of 5.5............and got visas......some are suggesting to repeat your IELTs and Daroooza is doing..........

Yes..applied under FSW2 on May 17, 2011....and got PER on July 11, 2011.

I did not enclose a letter explaining why i have not enclosed the BCs... mayb i should have...but thankfully allz well !

I agree with Ali. The process at CIO NS seems not to be similar. Am now wondering, would send the application again with coveting lette would help  Cry

Virajrao,

Thats the next best thing you can do...if you cant get the BCs...so i woud suggest reapplying with a covering letter explaining why BCs are not enclosed...Good Luck !
